Ili <br />DEPARTMENT OF <br />ECOLOGY <br />State of Washington <br />IAA No. C2600194 <br />INTERAGENCY AGREEMENT (IAA) <br />BETWEEN <br />THE STATE OF WASHINGTON, DEPARTMENT OF ECOLOGY <br />AND <br />KITTITAS COUNTY PUBLIC HEALTH DEPARTMENT <br />THIS INTERAGENCY AGREEMENT ("Agreement" or "IAA") is made and entered into by and between the <br />state of Washington, Department of Ecology, hereinafter referred to as "ECOLOGY," and the KITTITAS <br />COUNTY PUBLIC HEALTH DEPARTMENT hereinafter referred to as the "KCPHD" and "CONTRACTOR," <br />pursuant to the authority granted by Chapter 39.34 of the Revised Code Washington, Interlocal <br />Cooperation Act. <br />THE PURPOSE OF THIS AGREEMENT is to provide the delegation and funds to KCPHD to administer and <br />enforce the well sealing, tagging, and decommissioning portions of the water well construction regulations. <br />WHEREAS, ECOLOGY has legal authority (WAC 173-160) entitled Minimum Standards for Construction <br />and Maintenance of Wells and KCPHD (other party) has legal authority (RCW 18.104) entitled the <br />Washington Well Construction Act, that allows each party to undertake the actions in this agreement. <br />WHEREAS, KCPHD shall implement the provisions of the well tagging, sealing, and decommissioning <br />components of Chapter 173-160 WAC. Authority for this action of delegation and funding is provided <br />through the provisions of RCW 18.104.043 and 18.104.150. Delegation of authority to inspect wells <br />applies only to water supply wells. <br />Version 1/5/2026 <br />
