Access to telephone service comparable to that provided to Incarcerated Individuals by <br />the Sending Jurisdiction shall be provided to all transferred Incarcerated Individuals. <br />Section 5.16 RESERVED <br />Section 5.17 RESERVED <br />Section 5.18 Grievance Procedures. <br />Initial Sending Jurisdiction Incarcerated Individual grievances shall behandled by the <br />Receiving Jurisdiction, consistent with the Receiving Jurisdiction's grievance <br />procedures. The Sending Jurisdiction staff shall handle appeals or additional review <br />of the Sending Jurisdiction Incarcerated Individual grievances. <br />Section 5.19 Access to Courts. <br />The Sending Jurisdiction shall be responsible to provide meaningful access to the <br />courts through: (a) the use of court appointed attorneys to satisfy their Sixth <br />Amendment right to counsel, (b) contracted attorneys, or (c) legal materials at the <br />Receiving Facility. If meaningful access is to be provided through legal materials at <br />the Facility, the Sending Jurisdiction shall supplement the Receiving Jurisdiction's <br />legal materials as required to meet constitutional needs of Incarcerated Individuals. <br />The Receiving Jurisdiction will provide the Incarcerated Individual opportunity to <br />access to legal materials at the Facility or to their attorney in accordance with security <br />and operating needs and consistent with access granted to other Incarcerated <br />Individuals. <br />Section 5.20 Death of an Incarcerated Individual. <br />The Receiving Jurisdiction will immediately notify the Sending Jurisdiction via <br />telephone of any Incarcerated Individual death and shall have the death reviewed by <br />the coroner of the local jurisdiction. The Receiving Jurisdiction shall also forward a <br />certified copy of the death certificate, autopsy report, Incarcerated Individual's file and <br />medical records to the Sending Jurisdiction. <br />Section 5.21 Escape of an Incarcerated Individual. <br />The Receiving Jurisdiction will immediately notify the Sending Jurisdiction via <br />telephone of any Incarcerated Individual escape. The Receiving Jurisdiction shall also <br />notify all local law enforcement agencies of the escape. <br />Article VI <br />RECEIVING JURISDICTION EMPLOYEES <br />Section 6.1 Independent Contractor. <br />Receiving Jurisdiction shall perform its duties hereunder as an independent contractor <br />and not as an employee. Neither the Receiving Jurisdiction nor any agent or employee <br />of the Receiving Jurisdiction shall be deemed to be an agent or employee of the Sending <br />Jurisdiction. The Receiving Jurisdiction shall pay, when due, all required employment <br />taxes and income tax withholding including all Federal and State income tax and local <br />head tax on any monies paid pursuant to this Compact.
