Section 4.11 Notification of Coordinator. <br />The Sending Jurisdiction shall notify the Receiving Jurisdiction of the Sending <br />Jurisdiction coordinator responsible for administering the Compact. Should the <br />coordinator be absent for an extended period of time, the coordinator shall arrange for, <br />and notify the Receiving Jurisdiction in writing, of the alternate contact person during <br />the coordinator'sabsence. <br />Section 4.12 Access to Courts. <br />Receiving Jurisdiction agrees to provide Sending Jurisdiction Incarcerated Individuals in <br />Receiving Jurisdiction custody under this Compact meaningful access to the courts <br />through: (a) the use of court -appointed attorneys to satisfy their Sixth Amendment right <br />to counsel, (b) access to contracted attorneys provided by the Sending Jurisdiction, and/or <br />(c) access to legal resource materials at Receiving Jurisdiction. Receiving Jurisdiction also <br />agrees to provide the Sending Jurisdiction's Incarcerated Individuals access to assigned <br />or appointed attorneys in accordance with security and operating needs and consistent <br />with access granted to Receiving Jurisdiction Incarcerated Individuals. <br />4.12.1 Sending Jurisdiction will appear and defend Receiving Jurisdiction from any <br />challenges to confinement or conviction, such as petitions under habeas corpus. <br />Section 4.13 Reconciliation of Incarcerated Individual Days and Costs. <br />When the two Parties to this Agreement transfer Incarcerated Individuals to each other, <br />there shall be a reconciliation of the number of Incarcerated Individual Days accrued <br />by each Party. If the number of Incarcerated Individual Days accrued by each Party is <br />equal, no payment for Incarcerated Individual Days is necessary for the affected period, <br />except extraordinary medical, legal and transport costs. If the number of Incarcerated <br />Individual days is not equal, the Party accruing the lesser number of Incarcerated <br />Individual Days may credit any obligation of the other Party against their future <br />obligations or may bill the other Party for the excess accrued Incarcerated Individual <br />Days at the daily rate set by the Office of Financial Management under RCW 70.48.440, <br />unless the Parties have agreed to another rate for a particular transfer. <br />Section 4.14 Transportation and Security. <br />The Sending Jurisdiction shall provide transportation and security for Incarcerated <br />Individuals being transported to and from court appearances. <br />Section 4.15 Inspections. <br />The Sending Jurisdiction shall have the right to inspect and or audit the Receiving <br />Jurisdiction's Facility at its discretion, with or without advance notice. <br />Article V <br />RECEIVING JURISDICTION RESPONSIBILITIES <br />Section 5.01 Supervision. <br />The Receiving Jurisdiction shall be responsible for the supervision of the Incarcerated <br />Individuals that it accepts into custody from the Sending Jurisdiction. <br />Washington State K14078 Page 5 of 11 <br />Department of Corrections 26RAD <br />
