Secretary — Secretary of DOC or his/her designee. <br />Sending Jurisdiction — County or DOC, whichever has an Incarcerated Individual that they want the <br />other to house. <br />Article II <br />RIGHTS AND OBLIGATIONS <br />All rights and obligations of the Parties to this Agreement shall be subject to and governed by the special <br />terms and conditions contained in the text of this contract instrument and HIPAA AND DATA <br />SECURITY REQUIREMENTS, attached hereto as Attachment A. <br />Article III <br />TERM OF THE COMPACT <br />Section 3.01 Term. <br />The term of this Compact shall begin July 01, 2026, and continue until terminated <br />as provided below. <br />Section 3.02 Termination. <br />This Agreement may be terminated by any party, for cause, non- appropriation of <br />funds, or convenience, on thirty (30) days written notice, delivered to the County Jail <br />Director or the Contracts Administrator of DOC, as appropriate. Within 30 days after <br />the delivery of said notice, the Receiving Jurisdiction/Sending Jurisdiction shall retake <br />physical custody of their respective Incarcerated Individuals being housed at the other's <br />Facility pursuant to this Agreement. The requirement of written notice will not apply <br />if the Receiving Jurisdiction/Sending Jurisdiction, in its sole discretion, determines the <br />cause for termination creates an immediate threat to public safety, health, or welfare. <br />Section 3.03 Termination Due to Unavailability of Funds. <br />The payment of money by the Sending Jurisdiction under any provisions hereto is <br />contingent upon the availability of funds appropriated to pay the sums pursuant to this <br />Agreement. In the event funding for this Agreement becomes unavailable, withdrawn, <br />reduced, insufficient, or limited in any way, the Receiving Jurisdiction shall have the <br />right to terminate this term of this Agreement without penalty and without the thirty <br />(30) day notice period, except for services already provided. <br />Section 3.04 Intrastate Corrections Compact. <br />The provisions of the Intrastate Corrections Compact, pursuant to RCW 72.76, are <br />hereby made an integral part of this Compact and no provision of this Compact shall <br />be construed in any manner inconsistent with historical intent and the provisions of <br />the Intrastate Corrections Compact. <br />Article IV <br />SENDING JURISDICTION RESPONSIBILITIES <br />Washington State K14078 Page 2 of 11 <br />Department of Corrections 26RAD <br />
