Section 7.6 Scope of Agreement. <br />This Compact and any appendices or exhibits to it incorporate all the agreements, <br />covenants, and understandings between the Parties. No prior agreement or <br />understandings, verbal or otherwise, of the Parties or their agents shall be valid or <br />enforceable unless embodied in this Compact. This Compact shall not be altered, <br />changed, or amended except by mutual consent of the Parties in writing. <br />Section 7.7 Compliance with Applicable Laws, <br />The Parties shall at all times during the performance of their obligations of this <br />Compact, strictly adhere to all applicable federal and state laws and regulations. <br />Section 7.8 Indemnification. <br />Each Party agrees to be responsible and assume liability for its own wrongful and/or <br />negligent acts or omissions or those of their officials, officers, agents or employees to the <br />fullest extent require by law, and further agrees to save, indemnify, defend, and hold <br />the other Party(s) to the Intrastate Compact harmless from any such liability. It is <br />further provided that no liability shall attach to the County by reason of entering into <br />the Intrastate Compact except as expressly provided herein. <br />Article VIII <br />PREA - SEXUAL MISCONDUCT <br />Section 8.1 Compliance. <br />The Department will ensure that all employees, vendors, and volunteers that have contact <br />with either Party's Incarcerated Individuals comply with all federal and state laws <br />regarding sexual misconduct including, but not limited to: <br />8.1.1 The Prison Rape Elimination Act of 2003 (PREA); <br />8.1.2 The standards for adult Prisons and Jails or Community Confinement Facilities; <br />Whichever is applicable, as promulgated by the US Attorney; and <br />8.1.3 Zero tolerance toward all forms of sexual abuse and sexual harassment. <br />8.1.4 The Department need not Require PREA Compliance by the County to maintain <br />arrangements regarding temporary housing for the purpose of probation or parole <br />violations or temporary transfers for court appearances or testimony. <br />[REMAINDER OF THE PAGE INTENTIONALLY LEFT BLANK. <br />SIGNATURE PAGE FOLLOWS.] <br />Washington State K14078 Page 10 of 11 <br />Department of Corrections 26RAD <br />
