Modifications: -'12.1 Either party may request changes in the Agreement. Terminadqnlorlefaul!: lf the contractor defautts by faiting to perform any of the obtigations of the Agreement or becomes insotvent or is declared bankrupt or commits any act of bankruptcy or insotvency or makes an assignment for the benefit of creditors, the county may, by depositing written notice to the Contractor in the U.S. mai[, postage prepaid, terminate the A$reement, and at the CoUnty's option, obtain performance of the work etsewhere' lf the Agreement is terminated for defautt, the contractor shall, not be entitted to receive any further payments under the Agreement until, att work catted for has been ful'ty performed ' Any extra cost or damage to the county resuLting from such defautt(s) shatt be deducted from any money due or coming due to the contractor.
