ARTICLE 4 <br />Alcohol and Drug Abuse Patient Records <br />Medical Group aclmowledges that in receiving, storing, processing or otherwise dealing with information from <br />United or Payer about Customers, it is fully bound by the provisions of the federal regulations governing <br />Confidentiality of Alcohol and Drug Abuse Patient Records, 42 CFR Part 2, as amended (the "Confidentiality <br />Regulations"); an Medical Group agrees that it will resist in judicial proceedings any effort to obtain access to <br />information pertaining to patients otherwise than as expressly provided for in the Confidentiality Regulations. <br />ARTICLE 5 <br />Miscellaneous <br />5.1 Survival. Upon termination of the Agreement or this Addendum, the provisions herein, which <br />contemplate performance or observance subsequent to termination, will survive and remain of full <br />force and effect between the parties. <br />5.2 Entire Agreement. On the Effective Date, this Agreement and this Addendum will supersede and <br />replace any existing provider agreements between the parties related to the provision of Covered <br />MH/SUD Services for Benefit Plans to which this Addendum applies as described in the preamble, <br />including any agreements between Medical Group and United or a United Affiliate including <br />United Behavioral Health. This Agreement, together with any and all attachments, addenda, <br />appendices, as may be amended or modified from time to time, whether contemporaneous or <br />subsequently made, are hereby incorporated herein by reference, and constitutes the entire <br />agreement between the parties in regard to its subject matter. <br />Gen.AmdSMGA.BfI.
