The <br />Contractor shatttake such action with respect to this Agreement as may be <br />required to ensure futtcomptiance with local, state and federa[ laws <br />prohibiting discrimination in emptoyment. <br />30.3 Nondiscrimination inServices <br />The Contractor witl, not discriminate against any recipient of any services or <br />benefits provided for in this Agreement on the grounds of race, creed, cotor, <br />national origin, sex, sexuat orientation, maritaI status, age or the presence of <br />any sensory, mentaI or physicat handicap. <br />30.4 lf any assignment and/or subcontracting has been authorized by the County, <br />said assignment or subcontract shatL incLude appropriate safeguards against <br />discrimination. The Contractor shal.t take such action as may be required to <br />ensure futl, comptiance with the provisions in the immediatel,y preceding <br />paragraphs herein. <br />31. Prevail.ingWage: <br />The Contractor shatl, pay the prevaiting rate of wages to al,l, workers, [aborers, or mechanics <br />emptoyed in the performance of any part of the Work in accordance with RCW 39.12and <br />the rutes and regutations of the Department of Labor and lndustries. The schedute of <br />prevail,ing wages rates for the tocal,ity or Local,ities of the Work is determined by the <br />lndustriat Statistician of the Department of Labor and lndustries. lt is the Contractor's <br />responsibil.ity to verify the appticabl,e prevaiLing wage rate. lt is understood that the <br />Contractor is responsibte for obtaining and compteting al,l, required government forms and <br />submitting same to the proper authorities. <br />Disputes regarding prevaiting wage rates shal.t be referred for arbitration to the Director of <br />the Department of Labor and lndustries. The arbitration decision shatt be finat and <br />conctusive and binding on atL parties invotved in the dispute as provided for by RCW <br />39.12.060. <br />32. Debarment Certification: <br />The Contractor certifies that it: <br />g2.1 ls not presentl,y debarred, suspended, proposed for debarment, dectared <br />inetigib[e or votuntaril.y exctuded from covered transactions by any Federat <br />department or agencY. <br />32.2 Has not within a three-year period preceding the execution of this contract <br />with Kittitas County, been convicted of or had a civiI judgment rendered <br />against them for commission of fraud or a criminaI offense in connection <br />with obtaining, attempting to obtain, or performing a publ,ic or private <br />agreement or transaction, viotation of FederaI or State antitrust statutes or <br />Kittitas Cou nty ProfessionaI Services Agreement <br />Page 'l 3 oI2O
