Article 34 Required Use of Amerlcan lron, Sleel, Manulaelured Producls' and <br />preference onlyappliesto articles; materials; and supplies thatare consumed in, <br />incorporated into, or affxed to an infrastructure proiect. As such, it does not apply to <br />tools,equipment,andsupplies,suchastemporaryscafiolding,broughttothe <br />construction sib and removed at or befure the completion of the infrastructure <br />project. Nor does a Buy America preference apply to equipment and-furnishings' <br />iuci as mouable chairs, desks, and portable computer equipment, that are used at <br />or within the finished infrastructure projec't but are not an integral part of the <br />strucujre or permanently affxed to the infrastructrre proiect. waivers.when <br />n""otuw, recipients rnav apply for, and the agency may grant, a waiver from these <br />requirements. The agency should notify the recipient for information on the process <br />for requesting a waiver from these requirements. (a) when the Federal agency has <br />determined that one of the follosing exceptions applies, the awarding offcial may <br />waive fre application of tre domestic content procurement preference in any case <br />in which thti igency determines that (1) applying the domestic content proslrement <br />preference *duld be ittconsistent wite the public interest; (2) tire types of iron, steel, <br />manufacmed producb, or construclion materials are not produced in fre United <br />States in suficientand reasonably available quantitie$ or of a satisfacbry qulity; or <br />(si the inctusion of iron, steel, manufactured products, or constuction materials <br />irbOuceu in th€ United Stabs will increase the cost of the overall poject by more <br />itr* ZS p"r6nt.
