Section 12 of the existing agreement enables NGR to assign its interest in the agreement <br /> to another person or entity by providing written notice to Kittitas County. NGR wishes to <br /> assign its interest in this contract and all related water rights to Nelson Ltd Partnership <br /> ("Nelson Ltd Partnership"). Kittitas County,NGR, and Nelson Ltd Partnership also wish <br /> to extend the term of the agreement. A contract amendment has been prepared to extend <br /> the agreement, document the assignment to Nelson Ltd Partnership, and update the notice <br /> provisions accordingly. <br /> DISCUSSION: <br /> These service contracts with private water bank entities help ensure that water held by <br /> private banks is retained for use within Kittitas County and further secure the availability <br /> of water for use within the County. <br /> FISCAL IMPACTS: <br /> By selling private mitigation certificates, Kittitas County continues to collect the revenue <br /> required to support program staffing and to collect the in-lieu fee for watershed <br /> management identified in Kittitas County's 2014 Settlement Agreement.
