2.4 Holding Over. Any holding over by Tenant after the expiration or termination of the Lease hereof shall <br />be construed to be a tenaniy at sufferance ofthe Landlord on all ofthe terms and conditions set forth herein, to the extent <br />not inconsistent with a tenancy at sufferance; provided, that the Minimum Rent for such hold-over period shall be an <br />amount equal to two (2) times the Minimum Rent due for the last month of the Lease Term. Such tenancy at sufferance <br />may be terminated by either party by not less than thirty (30) days prior written notice. <br />2.5. Abandonment. Tenant agrees not to vacate or abandon the Premises at any time during the Lease Term' <br />Should Tenant vacate or abandon said Premises or be dispossessed by process oflaw or otherwise, such abandonment <br />vacation or dispossession shall be deemed a breach of this Lease and, in addition to any other rights which Landlord may <br />have, Landlord- may remove any personal property belonging to Tenant which remains on the Premises and store the same, <br />the cost of such removal and storage to be charged to the account of Tenant. Landlord's entry into the abandoned Premises <br />and/or Landlord's removal ofthe personal property as described above shall not be consfued or deemed to be a termination <br />ofthis Lease or an actual or constructive eviction ofTenant, nor shall the same relieve Tenant ofits obligations under this <br />Lease. Landlord shall have such rights of entry and removal in order to attempt to mitigate Landlord's damages in the <br />event of Tenant's abandonment of the Premises. <br />2.6 Voluntary Surrender. The voluntary or other surrender of this Lease by Tenant, or a mutual <br />cancellation ttrereof, shall not be a merger, but shall, at the option oflandlord, terminate all or any existing subleases or <br />sub tenancies, or operate as an assignment to it ofany or all such subleases or sub tenancies' <br />3. RENT. All rent payments as hereinafter set forth shall be paid by Tenant to Landlord without notice or <br />demand, in advance, e*"ept as otherwise specifically provided herein, on or before the lst day of each and every <br />successive calendar month during the Term hereof commencing on the Rent Commencement Date, and shall be <br />considered delinquent if not so paid on or before the first day of each month. The Minimum Monthly Rent and the <br />Additional Rents jhereinafter defined) are refened to collectively herein as "Rent." All Rent shall be paid to Landlord' <br />without deduction or offset, in lawful money of the United States of America, at PO Box 36, Ellensburg WA98926, <br />or at such other place as Landlord may from time to time designate in writing. If the Lease Terrn commences or expires <br />on a day other than the last day of a calendar month, the Minimum Monthly Rent for such month shall be a pro-rated based <br />upon athirty (30) day month. <br />3.1. Rent Commencement Date. Rent payments from Tenant to Landlord shall commence on the Rent <br />Commencement Date. <br />3.2. Initial Monthly Rent. For purposes of determining when the Rent increases begin, the earliest Possession Date by Landlord <br />is the Date which commences the Term ofthe Lease and is the date rent commences. A year of the Lease term commences <br />on the annual anniversary of the earliest Possession Date. As set forth in Section 7.2 defining the Tenant's improvements, <br />it may be possible for Landlord to complete the improvements to the East one-half of the building prior to the West one- <br />half, and in such event the Tenant shail pay fifty percent (507o) of the rental amounts due in Section 3'2 and 3.4 until <br />Commercial Building Lease <br />Page2 of26
