5. <br />shall at all times maintain the PREMISES and a I J improvements in a condition that is clean, <br />tree of debris, safe, sanitary, and in good repair, All structural components and fixtures <br />shall be maintained, repaired, and reconstructed so that their functional and economic <br />useful life reasonably extends to the end of the lease term, including all extensions and <br />including such items as structural components, root, exterior of structures, slabs and <br />paving, plumbing, heating and electrical. LESSEE shall perform all work in accordance <br />with federal, state, and local laws and regulations and in a good and workmanlike manner. <br />LESSEE shall promptly remedy any condition that fails to meet this standard. Without <br />limiting the foregoing, LESSEE shall not store on the PREMISES any inoperable vehicles <br />or equipment, discarded or unsightly materials, or materials likely to create a hazard; shall <br />not use areas outside of enclosed buildings for storage; and shall store trash in covered <br />metal receptacles. Any substance or material that is regulated by any Environmental Law <br />shall be governed by Section 7. If LESSEE fails to comply with this requirement after a <br />written request by LESSOR to comply, LESSOR may, but is not required to, cause the <br />removal of any such material or to eliminate any such defect, at LESSEE's sole expense by <br />any means that LESSOR reasonably determines. Any such costs incurred by Lessor shall <br />become due and owing immediately from LESSOR, and subject to late fees, penalties and <br />interest as set forth for late monthly payments. <br />4.9 Access: <br />LESSOR agrees that, if LESSEE is not in breach of this LEASE, LESSEE and LESSEE's <br />Associates(including, but not limited to agents/employees/invitees) are authorized for non- <br />exclusive ingress and egress across the common areas of the airport in the areas designated <br />by LESSOR and for the purposes for which they were designed, all as permitted by <br />applicable Laws and Regulations as defined in Section 4.2, to the extent reasonably <br />necessary for LESSEE's use, occupancy, and aircraft operations at the PREMISES. <br />LESSEE is at all times responsible for the actions of any and all Associates, both financially <br />and otherwise. <br />LESSOR'S AUTHORITY: <br />5.1 Nature of Lessor: <br />LESSOR is a governmental entity and the owner of the AERPORT, and LESSOR has all <br />lawful rights, powers, and privileges to act in those capacities. <br />LESSEEeW_ 6 LESSOR__ <br />m4m <br />
