Kittitas County Cle Elum Transfer Station Driveway Improvements and Tank Replacement Project Bid Documents ATTACHMENT “C” INSURANCE REQUIREMENTS Contractor shall secure and maintain in effect at all times during performance of work under this Agreement such insurance as will protect Contractor, its employees, and agents from all claims, losses, harm, costs, liabilities, damages and expenses arising out of Contractor’s performance under this Agreement, including but not limited to personal injury (including death) or property damage. All insurance shall be issued by companies admitted to do business in the State of Washington and have a rating of A-, Class VII or better in the most recently published edition of Best’s Reports unless otherwise approved by the County. If an insurer is not admitted, all insurance policies and procedures for issuing the insurance policies must comply with Chapter 48.15 RCW and 284-15 WAC. At a minimum, Contractor shall maintain and provide proof of the following selected options: ☒ Commercial General Liability Insurance  Coverage limits not less than: • $1,000,000 per occurrence, for all covered losses • $2,000,000 general aggregate • $1,000,000 products & completed operations aggregate • $1,000,000 personal and advertising injury, each offense  The policy must be endorsed to include the County and its officials, employees and agents as additional insureds. ☒ Commercial Automobile Liability Insurance  Automobile Liability for owned, non-owned, hired, and leased vehicles, with an MCS 90 endorsement and a CA 9948 endorsement attached if ‘pollutants’ are to be transported.  Coverage limits not less than: • $1,000,000 combined single limit ☐ Excess or Umbrella Liability  Contractor shall provide Excess or Umbrella Liability coverage of $5,000,000. This Excess or Umbrella Liability coverage shall apply, at a minimum, to both the Commercial General and Automobile Insurance policy coverages. If used to meet limit requirements, coverage must be at least as broad as specified for underlying coverages, and must cover those insured in the underlying policies.  This requirement may alternatively be satisfied through Contractor’s primary Commercial General and Automobile Liability coverage, or any combination thereof.  The policy must be endorsed to include the County and its officials, employees and agents as additional insureds.  Coverage shall be “pay on behalf”, with defense costs payable in addition to policy limits.  There shall be no cross liability exclusion precluding coverage for claims or suits by one insured against another. ☒ Workers’ Compensation & Employer’s Liability  Contractor shall provide Workers Compensation and Employer’s Liability insurance on a state-approved policy form providing benefits as required by law with employer’s liability limits no less than $1,000,000 per accident or disease. ☐ Professional Liability / Errors and Omissions Liability  Coverage limits not less than:
