BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br /> <br />RESOLUTION <br />NO.: 2026 - <br /> <br />RESOLUTION TO DECLARE PERSONAL PROPERTY SURPLUS TO THE <br />COUNTY AND TO AUTHORIZE AN INTERGOVERNMENTAL TRANSACTION <br /> <br />WHEREAS: Chapter 36.34 RCW provides the procedures for selling or conveying County <br />equipment or property that is no longer needed; and <br /> <br />WHEREAS: RCW 36.34.010 authorizes the Board of County Commissioners (“BOCC”) to <br />decide whether County-owned real or personal property is surplus to the needs <br />of the County, and whether disposal would be in the best interest of the County <br />and its people; and <br /> <br />WHEREAS: In 2004, Kittitas County Solid Waste (“Solid Waste”) purchased 3, 350-gallon <br />double-walled oil tanks, which are now surplus to the County’s needs; and <br /> <br />WHEREAS: The County of Chelan desires to purchase Solid Waste’s 3, 350-gallon <br />double-walled oil tanks for a total price of $3,000, which the BOCC deems to <br />be adequate consideration; and <br /> <br />WHEREAS: Kittitas County Code (“KCC”) 2.81.090(2) allows for intergovernmental <br />transactions of County property by negotiation, upon such terms as may be <br />agreed upon, and for consideration deemed adequate by the BOCC; and <br /> <br />WHEREAS: RCW 36.34.020 and RCW 39.33.020 exempt intergovernmental sales of <br />personal property valued at less than $50,000 from surplus property public <br />notice and hearing requirements. <br /> <br />NOW, THEREFORE BE IT RESOLVED that the Kittitas County Board of Commissioners <br />declares it to be in the best interest of the County and its people to declare Solid Waste’s 3, <br />350-gallon double-walled oil tanks as surplus to the County's needs, and authorizes the <br />intergovernmental transaction with the County of Chelan. <br /> <br />ADOPTED this day of 2026 at Ellensburg, Washington. <br /> <br /> BOARD OF COUNTY COMMISSIONERS <br /> KITTITAS COUNTY, WASHINGTON <br /> <br /> <br /> Cory Wright, Chairman <br /> <br /> <br /> Brett Wachsmith, Vice-Chairman <br />
