BOARD OF COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br /> <br />ORDINANCE NO. 2026 - _____ <br /> <br />AN ORDINANCE TO AMEND KITTITAS COUNTY CODE 3.04.090 <br /> <br />WHEREAS, the Board of Commissioners of Kittitas County hereby amends this Ordinance <br />pursuant to and by the authority of RCW 82.14.460, Ordinance 2021-017, and Article 11, §11 of <br />the Washington Constitution to enact regulatory measures to preserve, promote, and improve <br />public health; and <br /> <br />WHEREAS, the purpose of this amended Ordinance is to provide for and promote the health, <br />safety, and welfare of the general public, and not to create or otherwise establish or designate any <br />particular class or group of person who will or should be especially protected or benefited by this <br />Ordinance; and <br /> <br />WHEREAS, the provisions of this amended Ordinance shall be liberally construed for the <br />accomplishment of its purpose; and <br /> <br />WHEREAS, nothing contained in this amended Ordinance is intended to be nor shall be construed <br />to create or form the basis for any liability on the part of the Board of Commissioners, Kittitas <br />County, or any of its officers, employees, or agents, for any injury or damage resulting from the <br />failure of any person subject to Kittitas County Code 3.04.090 to comply with this Ordinance, or <br />by reason or in consequence of any act or omission in connection with the implementation or <br />enforcement of the above referenced code on the part of the Board of Commissioners, Kittitas <br />County, or any of its officers, employees, or agents; and <br /> <br />WHEREAS, Ordinance 2021-017 authorizes the Board of County Commissioners to remove the <br />expiration clause contained in section 6 of KCC 3.04.090; and <br /> <br />WHEREAS, the Board of Commissioners, after due deliberation subsequent to presentation by <br />County employees, local subject matter experts and professionals, and the public desires to amend <br />the mental health tax code by removing KCC 3.04.090(6) which reads: <br />6. The tax shall commence to be imposed January 1, 2022 and cease on December 31, 2027 <br />unless reauthorized by the Board of County Commissioners; and <br /> <br />WHEREAS, a public hearing was held on December 2, 2025, and the public was provided due <br />notice and opportunity to provide testimony on the proposed amendment to the Ordinance; and <br /> <br />WHEREAS, the Kittitas County Board of Commissioners believes that amending this Ordinance <br />by removing the expiration clause is in the best interest of Kittitas County. <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of Kittitas County <br />that Kittitas County Code 3.04.090 is hereby amended to read as follows:
