KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS <br />STUDY SESSION STAFF REPORT <br />STUDY SESSION DATE: January 26, 2026 <br />TOPIC: Commercial Property Assessed Clean Energy <br />and Resiliency (C-PACER) Program <br />ACTION REQUESTED: Direct staff prepare enabling documents for C- <br />PACER program. <br />LEAD STAFF: <br />Josh Fredrickson <br />RECOMMENDATION: <br />Direct staff to prepare enabling documents for consideration of the C-PACER program. <br />BRIEFING SUMMARY: <br />• Commercial Property Assessed Clean Energy and Resiliency (C-PACER) <br />Program is a financing mechanism authorized by RCW 36.165 <br />• C-PACER Program allows owners of eligible commercial properties to seek long- <br />term financing from private capital providers <br />• Loan agreement is between a private lender and the property owner, recorded at <br />the County <br />• County ordinance adoption would need to authorize C-PACER program within <br />the County <br />BACKGROUND: <br />In 2020 Washington State Legislature approved RCW 36.165, adopting the Commercial <br />Property Assessed Clean Energy and Resiliency (C-PACER) Program. The C-PACER <br />Program is a financing tool for long-term funding for qualified improvements. This is a <br />loan agreement between a private lender and the property owner. This program is an opt - <br />in program for Counties to consider. To establish the.Program, the County would need to <br />adopt an ordinance that would implement the program. <br />DISCUSSION: <br />Commercial Property Assessed Clean Energy and Resiliency (C-PACER) Program is a <br />financing tool which enables building owners to pay for improvements. The debt does not <br />appear as an obligation on the building owner's balance sheet, and the repayment <br />obligation stays with the property rather than an owner whenever the building is sold. <br />Private lenders fund improvements, including new and existing commercial, industrial, <br />
