INTERLOCAL AGREEMENT BETWEEN RITTITAS COUNTY AND THE <br />CONFEDERATED TRIBES AND BANDS OF THE YAKAMA NATION <br />This Interlocal Agreement (the "Agreement") is made and entered into by and between the <br />Confederated Tribes and Bands of the Yakama Nation (herein after the "Yakama Nation"), an <br />inherently sovereign nation that is federally -recognized pursuant to the Treaty with the <br />Yakama (12 Stat. 951), and Kittitas County through the Public Works Department (herein after <br />"Kittitas County" or the "County"). Yakama Nation and Kittitas County are each a "party," <br />and collectively the "parties." <br />RECITALS <br />WHEREAS, the Interlocal Cooperation Act, as amended, and codified in Chapter 39.34 of <br />the Revised Code of Washington ("RCW"), provides for public agencies to enter into <br />agreements for joint or cooperative action authorized under that chapter; and <br />WHEREAS, in 2023, the Washington State Legislature appropriated fiends in the 2023- <br />2025 Budget Proviso for the acquisition of Springwood Ranch for public purposes pursuant <br />to Section 3073 of Engrossed Substitute Senate Bill 5200, the text of which is attached as <br />Exhibit A and incorporated by reference (the "Springwood Ranch Legislation"); and <br />WHEREAS, pursuant to the Springwood Ranch Legislation, on October 31 st, 2024 the <br />Trust for Public Lands conveyed portions of Springwood Ranch to Kittitas County, the <br />Kittitas Reclamation District ("KRD"), the Yakama Nation, and Washington State acting by <br />and through Department of Fish and Wildlife ("WDFW") (collectively "Owners"); and <br />WHEREAS, Kittitas County entered into Grant Agreement No. WRYBIP-2325-KiCPWD- <br />00072 with the Washington State Department of Ecology for Springwood Ranch <br />stewardship and planning activities, which is attached as Exhibit B and incorporated by <br />reference ("Grant Agreement"); and <br />WHEREAS, stewardship and planning funding will be used to maintain core land <br />management functions during an interim management period and provide key services to <br />enable the Owners to transition the ranch to meet long-term management goal; and <br />WHEREAS, the Owners will work together to implement the scope of work authorized and <br />funded by the Grant Agreement. <br />NOW, THEREFORE, it is hereby agreed as follows: <br />TERMS <br />1) Legal Basis.
