<br />KNOW ALL BY THESE PRESENTS: That we, Belsaas & Smith Construction, Inc. as Principal, and
<br />, Western Surety Company as Surety, a corporation legally doing business in
<br />the State of Washington, are held and firmly bound and obligated unto the State of Washington and Kittitas
<br />County, pursuant to Chapter 39.08 RCW, in the full sum of $2,955,300.00 +
<br />WSST= $3,200,589.90 Dollars ($ 3,200,589.90 ) (Contract Price), and including any and all
<br />adjustments to the Contract Price, for the faithful performance of the Agreement referenced below, and for the
<br />payment of which sum we do bind ourselves, and each of our heirs, executors and administrators, successors
<br />and assigns, jointly and severally, firmly by these presents.
<br />WHEREAS, THE CONDITIONS OF THIS OBLIGATION ARE SUCH THAT the Principal entered into a
<br />certain Agreement with KITTITAS COUNTY, for Search and Rescue/EOC Facility, RR8504-1 incorporated
<br />herein by this reference and including all Contract Documents. This bond shall cover all approved change
<br />orders, amendments and modifications as if they were in the original Agreement. Similarly, this bond shall cover
<br />payment to the state with respect to claims for taxes, increases and penalties imposed under Titles 50, 51, and
<br />82 Revised Code of Washington (RCW).
<br />NOW, THEREFORE, if the Principal shall faithfully perform all terms and conditions of such Agreement and
<br />pay all laborers, mechanics and subcontractors and materialmen, and all persons who shall supply such person
<br />or persons or subcontractors with provisions and supplies for the carrying on of such work, and shall pay the
<br />State all taxes, increases and penalties under Titles 50, 51, and 82 RCW, which may be due, then this
<br />obligation is void, otherwise to remain in full force and effect until all claims filed in compliance with chapter
<br />39.08, and all State claims under Titles 50, 51, and 82 RCW are resolved.
<br />Provided, however, that the conditions of this obligation shall not apply to any money loaned or advanced to the
<br />Principal or to any subcontractor or other person in the performance of any such work.
<br />IT IS FURTHER DECLARED AND AGREED that whenever the Principal shall be, and declared by Owner
<br />to be in default under the Agreement, the Owner having performed Owner's obligations thereunder, the Surety,
<br />at the request of the Owner, shall promptly remedy the default in a manner acceptable to the Owner.
