discharged veteran or military status, or the presence of any sensory, mental or physical disability <br />or the use of a trained dog guide or service animal by a person with a disability. <br />21.3 If any assignment and/or subcontracting has been authorized pursuant to this <br />Agreement, said assignment or subcontract shall include appropriate safeguards against <br />discrimination. <br />22.Waiver. The waiver of any default or breach of this Agreement, or the failure of a party to enforce <br />any provision hereof or to exercise any right or privilege hereunder, shall not be deemed to waive any <br />prior or subsequent default or breach, the enforcement ofany provision hereof, or the exercise ofany <br />right or privilege hereunder, unless otherwise stated in a writing, signed by the parties hereto. <br />23. Professional Responsibility. Contracting Attomey shall adhere to the Rules of Professional <br />Conduct promulgated by the Washington Supreme Court and otherwise hold themselves up to the <br />highest ethical standard of professional responsibility and conduct. <br />24. Physical Office/Communications and Support Staff. The Contracting Attomey will maintain a <br />physical office or have access to an office that accommodates confidential meetings with clients; <br />maintains a postal address and adequate telephone service to ensure prompt response to client contact <br />and will provide sufficient support staff to provide for effective assistance of counsel. <br />25. Choice of Law and Venue. The parties agree that this contract shall be governed by Washington <br />State law and any action for breach or other remedy at law or equity shall be instituted only in the <br />Superior Court of Kittitas County. <br />26. Severance Clause If any term or condition of this Agreement or the application thereof to any <br />person(s) or circumstances is held invalid, such invalidity shall not affect other terms, conditions or <br />applications which can be given effect without the invalid term, condition or application. To this end <br />the terms and conditions of this Agreement are declared to be severable. <br />27. Construction: This Agreement has been mutually reviewed and negotiated by the parties and <br />should not be construed against the drafter. <br />28.
