-s I s r s. it-1M s â– sIS <br />5.45 If the County Provides Goods or Services in Exchange for a Donation: the Department/Office <br />shall provide a written disclosure statement for donations exceeding $75 if the County provided <br />goods or services in exchange for the donation. <br />The written disclosure statement must inform the donor that the amount of the contribution that is <br />deductible for federal income tax purposes is limited to the excess of money (and the fair market <br />value of property other than money) contributed by the donor over the value of goods and services <br />provided by the County. The written disclosure statement must also provide the donor with a good <br />faith estimate of the fair market value of the goods or services. <br />5.56 Sponsorships (Monetary and In -Kind): The following guidelines apply to monetary and in -kind <br />sponsorships: <br />5.66.1 Sponsorships worthless than $5,000: <br />A. The Department Director/Elected Official or their designee shall provide a written <br />disclosure statement, as described in Section 5.4, that includes details of any <br />traded benefits the sponsor may or will receive. <br />5.56.2 Sponsorships worth more than $5,000: <br />A. Require a formal agreement signed by the Department Director/Elected Official or <br />their designee (template agreements are included in the following appendices). A <br />written disclosure statement, as described in Section 5.4, shall also be provided. <br />5.67 Sponsorships (Title/Naming): Title sponsorships require a formal agreement that clearly defines <br />all stipulations, specific rights granted, and is signed by the Department Director. <br />5.67.1 Title sponsorships grant the sponsor certain rights. Those rights may consist of: <br />A. Displaying the company logo or other form of corporate recognition on County <br />property; <br />B. Promoting their investment with the County as indicated in the Sponsorship <br />Agreement; and/or <br />C. Naming rights for a facility, portion of a facility, program, or event. <br />5.67.2 Title sponsorships may not conflict with any current long-term agreements in place with <br />other parties. Department Directors should always research potential conflicts to meet <br />contractual obligations. <br />6 Limitations/Approvals/Responsibilities <br />6.1 Department Heads/Elected Officials should consult with the Prosecutor's Office when developing <br />and reviewing contracts and written agreements. <br />3 <br />
