UUUUwYlI CIIVVIUPU IU. %, IUU%,U--+U-/U.7C CVU-M`FV 5-4/11 Ul+GUOI.OVV <br />"Fiscal Coordinator" means the Contractor's employee who is assigned to be the liaison between <br />HCA and the Contractor for the accounting purposes of this Agreement. The Contractor may assign <br />the fiscal and RMTS coordinator roles to the same staff if desired. <br />"HCA Contract Manager" means the individual identified on the cover page of this Contract who <br />will provide oversight of the Contractor's activities conducted under this Contract. <br />"Health Care Authority" or "HCA" means the Washington State Health Care Authority, any <br />division, section, office, unit or other entity of HCA, or any of the officers or other officials lawfully <br />representing HCA. <br />"Health Insurance Portability and Accountability Act of 1996" or "HIPAA" means, as codified at <br />42 USC 1320d-8, as amended, and its attendant Regulations as promulgated by the U.S. <br />Department of Health and Human Services (HHS), CMS, the HHS Office of the Inspector General, <br />and the HHS Office for Civil Rights. HIPAA inlcudes the Privacy, Security, Breach Notification, and <br />Enforcement Rules at 45 C.F.R. Part 160 and Part 164. <br />"Individual(s)" means the person(s) who is the subject of PHI and includes a person who qualifies <br />as a personal representative in accordance with 45 C.F.R. § 164.502(g). <br />"Indirect Cost" means an operating expense that is allocated across more than one program. <br />"Indirect Cost Rate" means the ratio, expressed as a percentage, of the Indirect Costs to a Direct <br />Cost base as approved by the Contractor's Cognizant Agency. <br />"Information and Communication Technology" or "ICT" means information technology and other <br />equipment, systems, technologies, or processes, for which the principal function is the creation, <br />manipulation, storage, display, receipt, or transmission of electronic data and information, as well as <br />any associated content. Examples include computers and peripheral equipment; information kiosks <br />and transaction machines; telecommunications equipment; customer premises equipment; <br />multifunction office machines; software; applications; websites; videos; and electronic documents. <br />"LHJ Claiming Manual" or "Manual" means the HCA document or its successor including any <br />updates, that describes how the Contractor must manage their MAC program and provides program <br />guidance. <br />"Limited Data Set(s)" means a Data set that meets the requirements of 45 C.F.R. §§ 164.514(e)(2) <br />and 164.514(e)(3). <br />"Linkage" means connecting Clients to Medicaid Covered Services. <br />"Local Matching Funds" means the Contractor's non-federal tax dollars that are not otherwise <br />obligated and are designated or certified to match the FFP rate of reimbursement. <br />"MAC Activity" or "Allowable Activity" or "Reimbursable Activity" or "Claimable Activity" <br />means an activity that is administrative in nature, and necessary for the proper and efficient <br />administration for the Medicaid state plan which must be in compliance as described in <br />applicable federal, state, HCA and CMS Regulations, the CAP, Manual, and this Agreement. <br />Washington State Page 6 of 35 HCA IAA K8630 <br />Health Care Authority Revised 07/2023 <br />
