BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION <br />NO. <br />AUTHORIZING THE CHAIR OF COUNTY COMMISSIONER'S SIGNATURE ON THE <br />MUTUAL RESCISSION AND RELEASE OF WATER RIGHT PURCHASE AND SALE <br />AGREEMENT <br />WHEREAS: Kittitas County maintains a water banking program accepted by the Washington State <br />Department of Ecology and administered by the Public Works Department; and. <br />WHEREAS: On March 13, 2023, Kittitas County entered into a water right purchase and sale <br />agreement for water right certificate No. S4-84269-J, which was ratified by Resolution <br />2023-058; and <br />WHEREAS: On March 4, 2025, Kittitas County and sellers amended this purchase and sale agreement, <br />so that the purchased water right would be the consumptive and non -consumptive <br />portions associated with 2.5 acres of irrigation water for S4-84268-J instead of S4-84269- <br />J; and <br />WHEREAS: The Chair of County Commissioner's signature on the first amendment to water right <br />purchase and sale agreement was ratified by Resolution 2025-067; and <br />WHEREAS: The Seller of said water right has requested to terminate the water right purchase and sale <br />agreement; and <br />WHEREAS: Kittitas County and Seller have mutual agreement to rescind the prior water right <br />purchase and sale agreement and release all parties to that prior water right purchase and <br />sale agreement including any and all obligations under said agreement; <br />NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the best interest <br />of the public, does authorize the Chair of County Commissioner's Signature on the Mutual Rescission <br />and Release of Water Right Purchase and Sale Agreement. <br />DATED this 18t' day of November 2025, at Ellensburg, Washington. <br />Attest: <br />❑ Clerk of the Board- Julie Kjorsvik <br />❑ Deputy Clerk of the Board- Mandy Buchholz <br />BOARD OF COUNTY COMMISSIONERS <br />KITTITAS COUNTY, WASHINGTON <br />Laura Osiadacz, Chairman <br />Cory Wright, Vice -Chairman <br />Brett Wachsmith, Commissioner <br />
