1 2 J Exhibit D -Additional Provisions SEPA Following review, staffhas determined that the granting of this permit is categorically exempt from the State Environmental Policy Act of l97l ("SEPA") under WAC 197-l l-800(23)(a) and WAC 197-ll-800(5Xc). Consequently, no SEPA document is required prior to execution of this Franchise. FRANCHISE Term of Franchise. The term of this nonexclusive Franchise shall be ten (10) years trom the effective date of this Franchise. This Franchise may be renewed at the sole discretion of State. This Franchise is revokable by State at any time as further provided by Paragraph 14 (Termination) herein. Consideration. Franchisee will submit the amount of $ 1,340.20 as consideration for this Franchise. The total amount includes a processing fee of $412.00 and a use fee of $92S.19. The application fee has been waived under WAC 352-32-300 as Franchisee is a government entity. Nonexclusive Franchise. This Franchise granted herein shall be nonexclusive. State specifically reserves the right to grant, at any time, such rights, permits, licenses, and/ or franchises to other persons to use for similar or different purposes allowed hereunder as State deems appropriate. Subject to this Franchise, Franchisee shall not prevent or prohibit State from constructing, altering, maintaining, using, or affecting its jurisdiction over them or any part of them, State having full power and authority to make all necessary changes, relocation, repairs, or maintenance of said use area as State deems appropriate. 4. Approval of Plans. State has approved the plans and specifications within the application dated June 10,2025, on file. Nothing in this Franchise imposes any duty or obligation on State to determine the adequacy or sufficiency of Franchisee's plans and designs, or to ascertain whether Franchisee's construction is in conformance with the plans and specifications approved by State. Franchisee shall submit to State any changes to the plans and specifications for the project, which State may approve or reject. 5. Coordination of Activities. Franchisee shall coordinate the dates of its construction and other major activities on State's property with the Central Cascades Area Manager at (509) 655-4319 or such other employee of State as State may from time to time designate, and Franchisee shall provide said employee with at least seven (7) day's prior notice of its intent to enter upon State's property to commence such activity.
