Kittitas County Agreement for Services (rev. 5/14/25) <br />Page 5 of 19 <br /> <br />ATTACHMENT “C” <br /> <br />INSURANCE REQUIREMENTS <br /> <br />Contractor shall secure and maintain in effect at all times during performance of work under this <br />Agreement such insurance as will protect Contractor, its employees, and agents from all claims, losses, harm, <br />costs, liabilities, damages and expenses arising out of Contractor’s performance under this Agreement, including <br />but not limited to personal injury (including death) or property damage. <br /> <br />All insurance shall be issued by companies admitted to do business in the State of Washington and have <br />a rating of A-, Class VII or better in the most recently published edition of Best’s Reports unless otherwise approved <br />by the County. If an insurer is not admitted, all insurance policies and procedures for issuing the insurance policies <br />must comply with Chapter 48.15 RCW and 284-15 WAC. <br /> <br />At a minimum, Contractor shall maintain and provide proof of the following selected options: <br /> <br />☒ Commercial General Liability Insurance <br /> Coverage limits not less than: <br />• $1,000,000 per occurrence, for all covered losses <br />• $2,000,000 general aggregate <br />• $1,000,000 products & completed operations aggregate <br />• $1,000,000 personal and advertising injury, each offense <br /> The policy must be endorsed to include the County and its officials, employees and agents <br />as additional insureds. <br /> <br /> ☒ Commercial Automobile Liability Insurance <br /> Automobile Liability for owned, non-owned, hired, and leased vehicles, with an MCS 90 <br />endorsement and a CA 9948 endorsement attached if ‘pollutants’ are to be transported. <br /> Coverage limits not less than: <br />• $1,000,000 combined single limit <br /> <br />☐ Excess or Umbrella Liability <br /> Contractor shall provide Excess or Umbrella Liability coverage of $5,000,000. This Excess <br />or Umbrella Liability coverage shall apply, at a minimum, to both the Commercial General <br />and Automobile Insurance policy coverages. If used to meet limit requirements, coverage <br />must be at least as broad as specified for underlying coverages, and must cover those <br />insured in the underlying policies. <br /> This requirement may alternatively be satisfied through Contractor’s primary Commercial <br />General and Automobile Liability coverage, or any combination thereof. <br /> The policy must be endorsed to include the County and its officials, employees and agents <br />as additional insureds. <br /> Coverage shall be “pay on behalf”, with defense costs payable in addition to policy limits. <br /> There shall be no cross liability exclusion precluding coverage for claims or suits by one <br />insured against another. <br /> <br />☒ Workers’ Compensation & Employer’s Liability <br /> Contractor shall provide Workers Compensation and Employer’s Liability insurance on a <br />state-approved policy form providing benefits as required by law with employer’s liability <br />limits no less than $1,000,000 per accident or disease.
