Page 2 of 16 <br />Palouse to Cascades State Park Trail <br />Franchise # F488501KVE1 <br /> <br /> <br />STATE OF WASHINGTON <br />PARKS AND RECREATION COMMISSION <br />Diana Dupuis, Director <br /> <br />Palouse to Cascades State Park Trail – <br />Non-Exclusive Franchise Agreement # F488501KVE1 <br /> <br /> <br /> <br />THIS NON-EXCLUSIVE FRANCHISE AGREEMENT is issued by the STATE OF <br />WASHINGTON, WASHINGTON STATE PARKS AND RECREATION COMMISSION <br />(hereinafter “State”), to KITTITAS COUNTY (hereinafter “Franchisee”). The effective date of <br />this Non-Exclusive Franchise Agreement (hereinafter “Franchise”) is the date of last signature <br />below (hereinafter “Effective Date”). <br />AUTHORITY <br />State is acting under those authorities granted to State by RCW 79A.05.070 and Washington <br />State Parks and Recreation Commission action of March 22, 2018, Policy 55-06-1 (Less Than <br />Fee Simple Real Estate Transactions) and November 21, 2019, Policy 25-07-1 (Delegations of <br />Authority for Real Estate Transactions and Service). <br /> <br />USE <br />This Franchise authorizes the use of parkland for the purpose of: <br />Access and maintenance, including debris removal, grading, and reseeding, and <br />vehicle overhang on a portion of land 360 feet in length within the northern 25 <br />feet of State right-of-way, with all connections and appurtenances thereto <br />(“Facilities”), across, along, in, upon, and under State's property described and <br />shown in Exhibit A – Legal Description and B – Use Area Map, attached to and <br />made part of this Franchise. The term “use area” in this Franchise refers to State’s <br />property as described and shown in Exhibits A – Legal Description and B – Use <br />Area Map. <br /> <br />EXHIBITS <br />Exhibit A – Legal Description <br />Exhibit B – Use Area Map <br />Exhibit C – Inadvertent Discovery Plan (IDP)
