Docusign Envelope lD: CEBC6B3C-DFA1 -4BOC-AFE8-6A4A63440086 <br />2.3.8.3 Facility shall comply with the Natural Death Act, HCA, CMS and other <br />applicable rules concerning advance directives and, when appropriate, inform Members <br />or their representatives of their right to make anatomical gifts. Facility shall assure that <br />the existence of an Advanced Directive is documented in each Member's record in <br />compliance with the Patient Self-Determination Act of 1990. <br />2.3.9 Facility shall provide care in a culturally competent manner and shall provide or <br />arrange for interpretive services for each Member who is hearing impaired, or whose oral or <br />written language creates a barrier to access, for all contacts between Facility and Member <br />including appointments for provision of Covered Services, emergent and urgent services, <br />telephone contacts, and assistance with all steps necessary to file Member complaints and <br />appeals. Facility shall assure that all generally available written materials provided to <br />Members are developed at the 6th grade reading level, translated into the Member's primary <br />reading language, or audibly in the Member's primary language or provided in an alternative <br />medium or format acceptable to the Member and approved by CHPW. <br />2.4 Professional Providers. <br />2.4.I Facility shall ensure that each Facility-Based Provider and other providers privileged by <br />Facility shall exercise independent medical judgment and control over his/her professional <br />services. Nothing herein is intended to give CFIPW authority over Facility-Based Providers' <br />(or other providers') medical judgment or the means by which s/he practices within the scope <br />of his/her licensed, certified andlor registered practice. <br />2.4.2Facility shall cooperate in and comply with CHPW credentialing criteria and <br />verification procedures for Facility-Based Providers. Facility represents and warrants that <br />each of its Facility-Based Providers is fully qualified and duly licensed and/or certified by the <br />appropriate state or other governmental board or agency to provide healthcare services within <br />the scope of his/her license. Facility shall maintain such license(s) and/or certification(s) in <br />good standing. Facility will provide prompt written notice to CHPW of any changes in the <br />license or certification of any of its Facility-Based Providers, any legal or governmental <br />action, or any other situation which may adversely impair the provider's ability to provide <br />Covered Services to Members pursuant to this Agreement. <br />2.4.3 Facility shall orient Facility-Based Providers, employees and subcontractors to the <br />applicable terms of this Agreement,the Provider Manual, and to other areas specifically <br />designated by CHPW, including Member rights, marketing, enrollment and disenrollment <br />procedures, risk management, customer service, claims preparation and authorizations, <br />hospital admission notification and certification, transfer and discharge procedures. <br />2.4.4Facility shall provide an accurate list of Facility-Based Providers with status <br />designations as "employed by Facility" or "subcontracted with Facility" in Exhibit A. <br />Facility shall promptly notify CHPW in writing of changes in its list of Facility-Based <br />Providers and/or their status designations, and in no case less than thirby (30) days after any <br />such change. <br />2020 Facillty Agmt - Template Page 6 of5l Contract #5908 -662684
