BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION <br />NO.2025- <br />RESOLUTION AUTHORIZING THE EXERCISE OF CONDEMNATION AUTHORITY <br />UNDER RCW 8.08.010 FOR THE ACQUISITION OF RIGHT OF WAY AND A TEMPORARY <br />CONSTRUCTION EASEMENT FOR FLOOD MITIGATION ON WHISKEY CREEK, RE <br />. PARCEL NUMBERS 962710 and 962712 <br />WHEREAS: Kittitas County Resolution 2012-081 established a County -wide Flood Control Zone <br />District ("District") governed by the Board of County Commissioners and administered by <br />the Public Works Department, which also has the authority over the engineering, <br />construction, maintenance and administration of the Kittitas County Road Systems. The <br />District serves residents in both unincorporated areas and incorporated towns and cities by <br />providing technical assistance and implementing flood -reduction projects and programs; <br />and <br />WHEREAS: The residents of Kittitas County benefit from having a county -wide Flood Control Zone <br />District in accordance with RCW 86.15.010, et. seq., and amendments, changes, and <br />alterations thereto; and <br />WHEREAS: The Kittitas County Flood Control Zone includes the Whiskey Creek Siphon Project <br />location; and <br />WHEREAS: The Kittitas County Board of County Commissioners has the authority to establish or <br />affirm by resolution actions to support flood mitigation; and <br />WHEREAS: A siphon routing the Ellensburg Water Company canal under Whiskey <br />Creek will mitigate flooding and support the District is necessary for flood control <br />measures; and <br />WHEREAS: Right of way acquisition and a temporary easement are needed to construct the siphon <br />project; and <br />WHEREAS: The proposed acquisition for the placement of the siphon are attached hereto and <br />incorporated by reference; and <br />WHEREAS: The Flood Control Zone District made reasonable and diligent efforts to negotiate the <br />purchase of right of way and a temporary construction easement; and <br />WHEREAS: Despite these efforts, the Flood Control Zone District was unable to reach voluntary <br />agreements for the purchase of right of way and a temporary construction easement; and <br />WHEREAS: A Public Hearing was held, after due notice, on October 21st, 2025, at 2:00 pm to receive <br />public testimony on the proposed right of way and easement acquisitions; <br />
