E Poltution Liabitity <br />The Contractor shall prov'rde a Pollution Llablllty policy, providing coverage for <br />clairns irwolving bodily injury, property damage (including loss of use of tanglble <br />property that has not been physically injurd), cleanup costs, remediation, dlsposal <br />sr other handling of pollutants, lncluding oosts and expenses incured in ilre <br />investigation, defense, or seftlement of claims arising out of:. Gontractor's operations related to thls project; and/orr Remediation, abatement, repair, maintenance or other work wlth lead-based <br />palnt or materials crrntaining ashestos; and/orr Transportation of hazardous materials away from any site related to this project <br />Such Pollution Liability policy shall provide the followlng minimum coverage:r $ perclalmr $ annualaggregate <br />X Proportv Damage <br />The Contrac{or shall provide a policy that covers damage to Klttitas County <br />facilities, Including bulldlngs, equipment, grounds, etc. Such policy shall provide <br />tlre following minimum coverage:r $ peroctunence <br />f] Umbrella Coverace <br />Umbrella policies shall provide covenage at least as brcad as specified for <br />underlying coverages (CGL, Auto, Employe/s Liabllity) and ooverthose lnsured ln <br />the underlying policles, including additional insured. <br />' Arnount required forthis Agreement $ <br />Contrador shall fumish the County a Certiflcate of lnsurance to include the Policy <br />EndorsementslExcluslons as evldence that policies providlng insurance required by this <br />Agreement are in fullforce and effecL Gontractor hereby waives all rights of recoune, <br />including any right to which another may be subrogated, against Kittitas County for <br />personal injury, including death, and property damage.
