2025 Hazard Mitigation Plan <br />Kittitas County, Washington <br /> <br /> <br />Chapter 5: Mitigation Strategy 226 <br />Criteria Description <br />L Legal <br />It is critical that the jurisdiction or implementing agency have the legal authority to <br />implement and enforce a mitigation action. <br />• Does the community have the authority to implement the proposed <br />action? <br />• Are the proposed laws, ordinances, and resolutions in place to implement <br />the action? <br />• Are there any potential legal consequences? <br />• Is there any potential community liability? <br />• Is the action likely to be challenged by those who may be negatively <br />affected? <br />• Does the mitigation strategy address continued compliance with the <br />NFIP? <br />E Economic <br />Budget constraints can significantly deter the implementation of mitigation <br />actions. It is important to evaluate whether an action is cost-effective, as <br />determined by a cost benefit review, and possible to fund. <br />• Are there currently sources of funds that can be used to implement the <br />action? <br />• What benefits will the action provide? <br />• Does the cost seem reasonable for the size of the problem and the likely <br />benefits? <br />• What burden will be placed on the tax base or local economy to <br />implement this action? <br />• Does the action contribute to other community economic goals such as <br />capital improvements or economic development? <br />• What proposed actions should be considered but be “tabled” for <br />implementation until outside sources of funding are available? <br />E Environmental <br />Sustainable mitigation actions that do not have adverse effect on the environment, <br />comply with federal, state, and local environmental regulations, and are consistent <br />with the community’s environmental goals, have mitigation benefits while being <br />environmentally sound. <br />• How will this action affect the environment (i.e., land, water, endangered <br />species)? <br />• Will this action comply with local, state, and federal environmental laws <br />and regulations? <br />• Is this action consistent with community environmental goals? <br />E Equity <br />Does not create an opportunity for unequal distribution of resources; racism; affect <br />a particular segment of the population, including communities of color, <br />communities that face discrimination based on sex, sexual orientation or gender <br />identity, individuals with disabilities, individuals who identify with certain religion, <br />individuals with Limited English Proficiency, or rural communities, etc. <br />• Is the action consistent and systematically fair?
