The lead agency has determined that certain mitigation measures are necessary in order to issue a <br />Mitigated Determination of Non -Significance (MDNS) for this proposal. Failure to comply with <br />mitigation measures identified hereafter will result in the issuance of a Determination of Significance <br />(DS) for this project. The mitigation measures include the following: <br />Earth <br />1) A fill and grade permit is required pursuant to Kittitas County Code 14.05.050 <br />Air <br />1) A dust control plan shall be developed and implemented during construction of the project. <br />Water <br />1) Stormwater and surface runoff generated by this project must be retained and treated on site. Any <br />discharge onto WSDOT right-of-way will require an approved Utility Permit. <br />2) The applicant must provide legal water availability for all new uses on the proposed lots of this <br />project, which can be provided through a letter from a water purveyor stating that the purveyor <br />has adequate water rights and will provide the necessary water for the new use. <br />3) In accordance with KCC Chapter 13.35.027, the applicant shall provide one of the following <br />documents before final plat approval: <br />a. A letter from a water purveyor stating that the purveyor has adequate water rights and <br />will provide the necessary water for the new use; <br />b. An adequate water right for the proposed new use; or <br />c. A certificate of water budget neutrality from the Department of Ecology or other <br />adequate interest in water rights from a water bank. <br />4) All applicants for land divisions shall also submit information on "proximate parcels" held in <br />"common ownership" as those terms are defined in WAC 173-539A-030 and otherwise <br />demonstrate how the proposed new use will not violate RCW 90.44.050 as currently existing or <br />hereafter amended. Failure to obtain mitigation before commencement of an activity requiring <br />mitigation shall be a code violation subject to enforcement under Title 18 KCC. <br />Plants <br />1) The applicant is to work with Washington Department of Natural Resources to determine if a <br />Forest Practices Application is needed. <br />Critical Areas <br />1) All streams as mapped in the National Wetlands Inventory shall be identified and setbacks <br />retained as defined in Kittitas County Critical Areas Ordinance 17A for any proposed <br />development in or upon the subject property. <br />2) The applicant shall comply with Kittitas County Title 17A Critical Areas, as applicable. <br />3) The applicant shall sign a covenant placing parcel #'s 950570, 950581, 950582, 950583, 950584, <br />950585, 950586, 950587, 950588, 950589, 950590, 950591, 950592, 950593, 950594, 950595, <br />950596, 950597, 950598, 950761, & 950762 in a conservation easement. <br />Buildin6 <br />1) The applicant shall comply with all local, State and Federal regulations, including environmental <br />standards and regulations in place at the time of building permit application submittal. <br />2) The applicant shall comply with local regulations including Kittitas County Code Title 14.04 <br />Building Code, Title 17 Zoning, Title 17A Critical Areas, and Title 20 Fire and Life Safety- <br />2 <br />
