7.5 7.6 Mental Hgalth Advance Pirective. ln accordance wlth 71.32 RCW, Provider shall inform all Medicaid Members who present for mental health services of their right to a Mental Health Advance Directive, and shall provide technical assistance to those Medicald Members who express an interegt in developing and maintaining a Mental Health Advance Directive. A "Mental Health Advance Directlve" means a written document in which the Medicaid Member makes a declaration of instructions, or preferences, or appolnts an agent to make declslons on behalf of the Medicaid Momber regardlng the Medicaid Member's mental health treatment. Provider shali also maintain current copies of any Medicaid Member's Mental Health Advance Directive ln the Medicaid Member's record and shall lnform Medlcaid Members that complaints concerning noncompliance with a Mental Health Advance Dlrective should be refened to the Department of Health. Compliance wllh 42 CFR Part 2. To the extent that in performing its servlces under this Attachment, Provider uses, dlscloses, maintains, or transmits protected health information that is protected by 42 CFR Parl 2, Provider acknowledges and agrees that ln recelving, storing, processing or othorwise dealing with any such records for Medlcaid Members, Provider is fully bound by 42 CFR Part 2; and, if necessary will resist any efforts to obtain access to such records except as permltted under 42 CFR Part 2. Notwitlrstanding any other language in this Aftachment, Provlder acknowledges and agrees that any Medicaid Member information Providor receives that is protected by 42 CFR Part 2 is subject to protections that prohlblt Provider from disclosing such information to agents or subcontractors without the specilic written consent of the Medicaid Member. 7.7 Washlngton Ent6rprls6 Provlder Agreement Mddlcald Attachment @ 2024 July- Wellpoint Washlngton, lnc. Provider Subcontractors. ln addition to lhe Provider Subcontractors provision ln the Agreement, if Provtder delegates or subcontracts any functlons of Wellpoint delegated by Wellpoint to Provider, Wellpoinfs consent to such aclion is required and the agreement governing such subcontract or detegation shall include all applicable roqulrements of the Government Contract (or any successor sections thoreto). 1 18393215629 oila6Eo25
