9.12 9.13 9.14 9,15 Sevefab*ilitv, ln case any one or more of the provisions of thls Agreement shall be invalid, lllegal, or unenforceable in any respect, the remalnlng provlsions shall bo construed liberally in order to effectuate the purposes hereof, and the validity, legglity and enforceability of the remaining provisions shall not ln any way be affected or impaired thereby. lf one or more provisions of the Agreement are invalid, illejal or unenforceable and an amendment to the Agreement is necessary to maintain its integrity, the partbJ shall make commerclally reasonable efforts to negotiate an amendment to this Agreernent and any attachments or addenda to this Agreement which could reasonably be construed not to contravene such statute, regulaflon, or interpretatlon. [n addltion, lf such invalid, unenforceable or materially affected provlsion(s) may be savered from this Agreement and/or aftachments or addenda to this {greement without materially aff6clin! the parles' intent when this Agreement was executed, then such provision(s) shall be ssvered rather than teiminating the Agrooment or any attachmonts or addenda to this Agreement. Nelther the waiver by either of the parties of a breach of any of the provislons of this Agreement, nor thefailure of either of the parties, on one ormore occasion, to enforce any of the provisions of this Agreement, ehall thereafter be construed as a waiver of any subsequent breach of any of the provisions of this Agreement. Construc-tion.
