30.3 <br />30.4 <br />required to ensure futt compliance with locai, state and federal Laws <br />prohibiting discrimination in em ployment. <br />Nondiscrim i nation in Services <br />The contractor witl not discriminate against any recipient of any services or <br />benefits provided for in this Agreement on the grounds of race, creed, cotor, <br />nationat origin, sex, Sexual Orientation, maritat status, age or the presence of <br />any sensory, mentaI or physical' handicap. <br />lf any assignment and/or subcontracting has been authorized by the County' <br />said assignment or subcontract shal.l inctude appropriate safeguards against <br />discrimination. The Contractor shalt take such action as may be required to <br />ensure futt comptiance with the provisions in the immediatety preceding <br />paragraphs herein. <br />31. PrevaitingWage: <br />The Contractor shalL pay the prevaiting rate of wages to att workers, laborers, or mechanics <br />emptoyed in the performance of any part of the work in accordance with RCW 39'1 2 and <br />the rutes and regutations of the Department of Labor and lndustries. The scheduLe of <br />prevaiting wages rates for the tocatity or locatities of the Work is determined by the <br />lndustriat Statistician of the Department of Labor and lndustries' lt is the Contractor's <br />responsibitity to verify the appticabte prevail,ing wage rate. lt is understood that the <br />Contractor is responsibte for obtaining and compteting aLt required government forms and <br />submitting same to the proper authorities. <br />Disputes regarding prevailing wage rates shatL be referred for arbitration to the Director of <br />the Department of Labor and lndustries. The arbitration decision shati be finat and <br />conctusive and binding on att parties invol.ved in the dispute as provided for by RCW <br />39.i 2.060. <br />3 2. Debarment*As*itlcagani <br />The Contractor certifies that it: <br />32.1 ls not presentty debarred, suspended, proposed for debarment, dectared <br />inetigibLe or voluntarily exciuded f rom covered transactions by any Federat <br />dePartment or agency. <br />32.2 Has not within a three-year period preceding the execution of this contract <br />with Kittitas County, been convicted of or had a civit judgment rendered <br />against them for commission of fraud or a criminat offense in connection <br />with obtaining, attempting to obtain, or performing a pubtic or private <br />agreement or transaction, violation of Federal or State antitrust statutes or <br />commission of embezzlement, theft, forgery, bribery, fatsification or <br />destructiOn of records, making faLse statements, tax evasion, receiving <br />stoten property, making fal,se cLaims, or obstruction of justice. <br />Kittitas County Professionat Services Agr'eement <br />Page13of21
