(a- ' -j . -, I , ':,1 r,, 2016,2016) <br />9.45.02O Public disturbance - finding of special eonditions" <br />The making, creation or maintenance of excessive, unnecessary or unusual loud noises which are <br />prolonged and unusual in theirtrme, place and use, affect and are a detrimentto public health, <br />comfort, conrzenience, safety, welfare and prosperity of the people of the county. The board of <br />county commissioners and the county shenff's department have received numerous citizen's <br />complaints regarding noise and beliel,e such noise constitutes a public disturbance. Special <br />condrtions yyrthin the county make necessary any and all differences bettryeen this chapter and <br />regulations adopted by the Department of Ecology 2016; lii l,- ] r-I-., 2016) <br />9.45.030 Fublic disturbance - noise unlawful when. <br />1. lt is unlarrrrfulfor any person to make, continue, or caLrse to be made or continued or any <br />person owning or in possession of propertyto make, continue, or caLlse to be made or <br />continued or allow to originate frorn the property any sound which: <br />a. ls plainly audible within any dwelling unit which is not the source of the <br />sound or is generated within two hundred feet of any dwelling unit, and, <br />b. Either reasonably annoys, disturbs, injurres or endangers the comfort, <br />repose, health, peace or safety of others <br />2. Sound r,vhich is "plainly audible" is sound that can be understood or rdentified. <br />3 lt shall be a rebuttable presumptron that sounds created between B:00 a.m. and 10:00 <br />p.m. do not unreasonably annoy, disturb, in.,1ure, or endanger. <br />201 6; arl.!'_1j:!:2, 2016) <br />9.45.040 Exemptions. <br />The following sounds are exempt from the provisions of this chapter: <br />1. Sounds originating from aircraft rn flight and sounds whrch orrginate at airports and are <br />drrectly related to flight operations, <br />2.
