CITY OF CLE ELUM/KITTITAS COUNTY SHERIFF <br />4. LESSOR'S INFORMATION TECHNOLOGY E;- UIIEMENT: Lessor maintains Information <br />Technology equipment on the premises. Lessee will allow Lessor access to said Information Technology <br />equipment, which may require twenty-four (24) hours, seven (7) days a week access with no notice. It is <br />Lessee's responsibility to safeguard the Information Technology equipment from damage caused by <br />Lessee or by third parties given access to the premises by Lessee. The Lessee shall be responsible to <br />correct or- y fa--anydamagescaused-to-the7-Information—Technology-equipmentthat-may=occur-during <br />the term of the lease, to the .extent that Lessee's acts or omissions caused such damage. <br />5. PURPOSE: The Lessee shall utilize the premises primarily for Sheriffs Office purposes supporting <br />Search and Rescue operations. <br />6. IMPROVEMENTS: Upon termination of this lease, the premises shall be left in a neat and orderly <br />condition and without debris. Should the premises not be left in such condition, after Lessee received <br />such notice, Lessor may remove debris left behind by Lessee and seek reimbursement from Lessee for <br />the costs of debris removal in any manner allowed by law. The property belonging to each party at the <br />commencement of the lease term shall remain the property of each such party at the termination of the <br />lease. <br />7. REPAI��S: The Lessor shall maintain the premises in good repair and tenantable condition during the <br />term of this lease, including without limitation roofing and covering materials (including floor and window <br />coverings), foundations, sidewalks, drainage, exterior and interior walls (including windows and doors), <br />plumbing, fire suppression systems, and heating, ventilation, mechanical, lighting and electrical systems <br />installed or furnished by the Lessor. If any repair or maintenance is required in whole or in part because <br />of any negligent or wrongful act or omission of the Lessee, its agents, employees or invitees, Lessee shall <br />be responsible for the cost of such repair and maintenance. <br />(a) The Lessee agrees that it will not commit waste and that it will keep said premises in a safe, <br />sanitary, neat, presentable, and otherwise good condition, and in general shall comply with all the <br />applicable governmental rules, ordinances and regulations as may be required or imposed by such <br />authorities on said premises and shall comply with any direction pursuant to law of any public officer or <br />officers who shall be empowered to enforce local, state and federal rules, regulations and ordinances upon <br />the Lessee with respect to the said premises or the use, occupancy, or control thereof and shall not suffer <br />any improper or offensive use of said premises. <br />8. AREA MAINTENANCE: Lessee shall, during the term of this lease, maintain the outdoor leased area to <br />the reasonable satisfaction of the Lessor. The area shall be kept free of all debris, weeds, and brush for the <br />term of this lease. <br />9. NOTICES: Any notice given by one party to the other in connection with this lease agreement shall be in <br />writing and shall be sent by certified or registered mail, return receipt requested as follows: <br />(a) If to Lessor, addressed to: <br />City of Cle Elum <br />119 West First <br />Cle Elum, Washington 98922 <br />(b) If to Lessee, addressed to: <br />PAGE 2 <br />
