KITTITAS COUNTY Goodwin Road Nav Cover Storage Lease <br />12.4. Comply with all applicable governmental statutes, ordinances, rules, regulations, <br />management plans and requirements regarding the proper and lawful use, handling, <br />disposition, transportation, generation, treatment, and disposal of <br />HAZARDOUS SUBSTANCES. <br />12.1 Cleanup Costs, Default and Indemnification: <br />LESSEE shall be fully and completely liable to LESSOR and shall indemnify, defend and save <br />LESSOR harmless from any and all cleanup costs, and any and all other charges, fees, penalties <br />(civil and criminal) imposed by any governmental authority with respect to LESSEE's unauthorized, <br />negligent or illegal use, handling, disposal, transportation, generation and/or disposal of <br />HAZARDOUS SUBSTANCES, in or about the PREMISES. Upon LESSEE's default under this <br />Section 14, in addition to the rights and remedies set forth elsewhere in this LEASE, LESSOR shall <br />be entitled to the following rights and remedies: <br />12.1.1 At LESSOR's option, to exercise the remedies under the procedures set forth in <br />Section 12; and <br />12.1.2 To recover any and all damages associated with the default, including, but not <br />limited to cleanup costs and charges, civil and criminal penalties and fees, loss of COUNTY <br />revenue by LESSOR, any and all damages and claims asserted by third parties and <br />LESSOR's attorneys' and consultants' fees and costs. <br />13) ABANDONED PROPERTY: Upon the Termination Date or earlier termination of this Lease, all <br />hay that LESSEE leaves on the Premises shall conclusively be deemed to have been abandoned <br />;and may be appropriated, sold, stored, destroyed, or otherwise disposed of as the LESSOR sees <br />fit: <br />14) WAIVER: No assent, express or implied, by LESSOR to any breach of any of LESSEE'S <br />covenants, agreements, conditions or terms hereof shall be deemed or taken to be a waiver of <br />any succeeding breach of any covenant, agreement, condition or term hereof. <br />15) INSPECTION: At all times during the term of this lease, LESSOR shall have the right to enter <br />into and upon the demised premises during reasonable business hours for the purpose of <br />examining and inspecting the same and determining whether LESSEE shall have complied with <br />all of its obligations hereunder in respect to the care and maintenance of the premises and all <br />other terms and conditions hereof. <br />PAGE 4 <br />
