7.6.7. Lots or parcets created by the finat ptatting of a subdivision or short subdivision may not <br />be further divided within a five-year period without fiting of a finat ptat; except as provided <br />forin RCW58.17.060. <br />7.6.8. lts comptiance with Kittitas County Code Chapter 13.35, Adequate Water Suppty <br />Determination or work voluntarity with Kittitas County to develop an authorized <br />conservation easement, see section 16.08.061 . <br />7.6.9. Hearing Examiner Finding: The proposat; 1) conforms to a[[ county subdivision, zoning, <br />heatth and sanitation, roads and bridges, and fire and life safety regutations and with laws <br />adopted by the state of Washington, 2) conforms to atl standards and improvements <br />required under this titte, 3) has no hazards created by ftood potentiat, [andstides, etc., 4) <br />makes provisions for att improvements and easements, 5) outtines access for atl <br />proposed tots, 6) indicates no hindrance to the pubtic interest, 7) is not beingfurther <br />divided from an incomplete ptat, and 8) compties with KCC 13.35 to determine adequate <br />water suppty. staff finds that the proposed short ptat, as conditioned, is consistent with <br />atl appticabte Washington State and Kittitas County codes. <br />8. Notice of Apptication: Apptications for a Ptanned Unit Devetopment and a Pretiminary Short Plat were <br />submitted to Kittitas County Community Devetopment Services (CDS)on March 26,2024 with updated <br />apptication fites submitted on June 3, 2024 (lndex #s 1-19A). The apptication was deemed comptete on May <br />23,2024 (lndex# 20). The site was posted with a sign for Notice on June 7th,2024 (lndex # 211. A Notice of <br />Apptication was maited to att state and locaI agencies/departments with potential interest in the project and <br />required by SEPA, as wett as to adjacent landoWners located within five hundred (500)feet of any portion of <br />the boundary of the proposal's tax parcel on June 20,2024 (lndex# 22.) and Notice to the Daity Record was <br />posted the same date. An error was discovered in the Notice, and the Notice of Apptication was re-issued to <br />Kittitas County agencies on Juty 23,2024 (lndex # 25). Notice of SEPA Action and the SEPA MDNS was issued <br />on November 14,2024 (lndex#33). A notice of Pubtic Hearingwas issued on December 3,2024 (lndex# 35). <br />Project apptication process and review was performed in conformance with the Kittitas County Project <br />Permit Apptication Process (Titte 1 5A). <br />9. COMPREHENSIVE PLAN <br />9.1. The Kittitas County Comprehensive Plan designates the proposal as a ptanned unit development <br />with a short ptat, transfer of devetopment rights and a SEPA checktist located off State Route 903 <br />approximatety 3.6 miles northwest of the intersection of State Highway 903 and Butt Frog Road, <br />northwest of Roslyn, WA with RuraI Recreation [and use designation. Kittitas County has <br />estabtished the fottowing goats and poticies to guide activities in these areas. These goats and <br />poticies were developed in response to identified needs within the county, and support the <br />County Wide Ptanning Poticies: <br />9.1.1. LU-G4: Maintain a ftexibte balance of tand uses which witl protect, preserve, and enhance <br />the ruraI character, historical forest lands, agricutturaI industries, minera[ [ands, and <br />high- quatity environment. <br />9.1.1.1. Consistency Statement: The short ptat witl create two tots; one around an <br />existing home atlowing continued open range use of the rest of the property. <br />9.1.2. LU-G5: Coltaborate with cities to participate in the County's transfer of devetopment <br />rights (TDR) program, to encourage and promote the protection of Rural Lands, Resource <br />Lands and frequentty ftooded areas. <br />9.1.2.1. Consistency Statement: The ptanned unit development will incorporate the <br />transfer of devetopment rights from a more rural area of the PUD to an area of <br />more intense devetopment to promote the protection of these ruraI areas for <br />conservation and recreation. <br />9.1.3. H-P3: ldentify tands within areas which are served by centratized water and sewer <br />systems, paved streets, and have other pubtic services provided to them which are <br />suitabte for higher density residentiaI use, inctuding mutti-famity and singte famity <br />planned unit devetopments and clustered housing.
