Faiture to obtain mitigation before commencement of <br />an activity requiring mitigation shatt be a code viotation subject to <br />enforcement under Titte 18 KCC. <br />11.10.7. Metering is required for att new uses of domestic water for <br />residentiaI well connections and usage must be recorded <br />in a manner consistent with Kittitas County Code Chapter <br />1 3.35.027 a nd Ecotogy regutations." <br />11.1O.7.1.2. The approvat of this division of land provides no guarantee <br />that use of water under the ground water exemption (RCW <br />90.44.050) for this ptat or any portion thereof witt not be <br />subject to curtaitment by the Department of Ecotogy or a <br />court of [aw." <br />1 1 .10.8. Appticant Response: No response. <br />1 1 .10.9. Hearing Examiner Finding: The SEPA Determination has been conditioned to meet the <br />requirements of Kittitas County Pubtic Works. <br />11.'11. Pubtic Comments: Pubtic comments are shown in lndex# 28. Comments received inctuded the <br />fottowing concerns: Access & parking impacts within Pine Loch Sun, northwest of the Ptanned <br />Unit Development. Concerns regarding the impact to existing water and sewer within Pine Loch <br />Sun. lnterest in mutuatty beneficiat projects targeting reductions in witdfire risk. Pine Loch Sun <br />wishes to ensure continuity in access to Ridgecrest and/or Thunder Road as estabtished through <br />historic precedent. <br />1 2. VI I I. PROJ ECT ANALYSIS & CONSISTENCY REVI EW <br />12.1. In review of this proposat, it is important to consider the goats and poticies of the comprehensive <br />ptan, applicabte county code, pubtic and agency comments, any identified environmentaI <br />concerns and state and federaI requirements. <br />12.1.1. Consistency with the comprehensive Plan: The proposa[ is consistent with the goats and <br />poticies of the Kittitas County Comprehensive Plan. As referenced above in Section V of <br />this staff report, the fottowing Comprehensive Ptan poticies appty to this proposat: LU-G4, <br />LU- G5, H-P3, RR-G8, RR-GI6. <br />12.'l .2. Consistency with the provisions of KCC 17A, CriticaI Areas: A criticat area review was <br />performed by staff, and GIS data indicates a Type 9 (unidentified) stream running through <br />parcels 950570, 950583 & 950584. The GIS data indicates a Type 4 Seasona[ (non-fish <br />bearing) stream running through parcels 12065 and 20202. The GIS data indicates a <br />CriticatArea Aquifer Recharge (CARA)for Group AWetthead Protection Areas. SEPA <br />Checktist was submitted with the apptication and an MDNS was issued on November 14, <br />2024. <br />'12.1.3. Consistency with the provisions of KCC 16.32.050, Short Ptat Review: This proposat, as <br />conditioned, is consistent with the Kittitas County Short Ptat Review requirements. The
