KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />AGENDA STAFF REPORT <br />AGENDA DATE: March 18, 2025 <br />ACTION REQUESTED: Request to Approve the Resolution to Ratify the Chair of <br />County Commissioner's Signature on First Amendment to <br />Water Right Purchase and Sale Agreement. <br />BACKGROUND: Kittitas County maintains a water banking program <br />accepted by the Washington State Department of Ecology <br />(WDOE) and administered by the Public Works <br />Department. On March 14, 2023, Kittitas County entered <br />into a water right purchase and sale agreement with David <br />W. Adams, Leann Adams, William Craig, and Constance <br />Craig to purchase the consumptive and non -consumptive <br />portions of the Water Right with a priority date of June 30, <br />1871 and assigned certificate No. S4-84269-J. This <br />acquisition will support an expansion of the current water <br />bank service area. <br />Upon subsequent discussions with the seller, Kittitas <br />County and the Seller decided to amend the purchase and <br />sale agreement, to purchase a portion of a different Wilson <br />Creek water right held by the sellers, with the same priority <br />date as the original water right under purchase agreement. <br />On March 4, 2025, the County and sellers entered into an <br />amended water right purchase and sale agreement. Chair <br />signature on the purchase and sale agreement amendment <br />must be ratified. <br />INTERACTION: Public Works. <br />RECOMMENDATION: Move to approve a Resolution to Ratify the Chair of <br />County Commissioner's Signature on First Amendment to <br />Water Right Purchase and Sale Agreement. <br />HANDLING: Return one (1) original to Public Works. <br />ATTACHMENTS: Resolution <br />Agreement <br />LEAD STAFF: Arden Thomas, Water Resource Program Manager. <br />
