7.1.1.2. To encourage more economical and efficient use of land, streets, and public <br />services; <br />7.1.1.3. To preserve and create usable open space and other amenities superior to <br />conventional developments; <br />7.1.1.4. To preserve important natural features of the land, including topography, <br />natural vegetation, and views; <br />7.1.1.5. To encourage development of a variety of housing types and densities; <br />7.1.1.6. To encourage energy conservation, including the use of passive solar energy in <br />project design and development to the extent possible; <br />7.1.1.7. To encourage development of areas or site characterized by special features <br />of geography, topography, size, shape; and/or <br />7.1.1.8. To permit flexibility of design that will create desirable public and private open <br />space; to vary the type, design and layout of buildings; and to utilize the <br />potentials of individual sites and alternative energy services to the extent <br />possible. <br />7.2. KCC 17.36.15(2) Applicability <br />7.2.1. Outside the Urban Growth Area (UGA) and Rural LAMIRDs: The provisions of this chapter <br />can be used for properties over twenty (20) acres in size, except that PUDs are prohibited <br />on Resource Lands and Rural Lands in the Rural Working Land Use Designation. <br />7.2.2. Hearing Examiner Finding: The subject property is 164.32 acres in size, and is outside the <br />Urban Growth Areas and Rural LAMIRDs. As proposed, the project is consistent with this <br />provision. <br />7.2.2.1. Uses proposed in the proposal include: <br />7.2.2.1.1. 61 residential lots, may include multiple-family lots on 69.15 <br />acres. <br />7.2.2.1.2. Recreation and open space on 96.91 acres. <br />7.3. KCC 17.36.020(2) Allowed uses <br />7.3.1. Under KCC 17.36.020(2), the allowed residential uses outside of an Urban Growth Area <br />include: <br />7.3.1.1. Accessory dwelling unit; <br />7.3.1.2. Accessory living quarters; <br />7.3.1.3. Dwelling, single-family; <br />7.3.1.4. Dwelling, two -family; <br />7.3.1.5. Dwelling, multiple-family; <br />7.3.1.6. Special care dwelling; <br />7.3.1.7. Parks and playgrounds. <br />7.3.2. Under 17.36.020(2)(b) the following uses are allowed provided they only serve the <br />residential PUD: <br />7.3.2.1. Community buildings; <br />7.3.2.2. Indoor recreation facilities including athletic clubs, fitness centers, sports <br />courts, swimming pools, and other similar uses; <br />7.3.2.3. Outdoor recreation facilities including swimming pools, sports courts or <br />Similar uses; <br />7.3.2.4. Electrical vehicle infrastructure, pursuant to KCC Chapter 17.66; and <br />7.3.2.5. Recreation vehicle storage areas. <br />7.4. KCC 17.36.025(2) Allowed Density <br />7.4.1. Outside the Urban Growth Area (UGA) and Rural LAMIRDs: The density of the underlying <br />zone combined with the existing density within the boundaries of the proposed PUD shall <br />not be exceeded by a PUD. The applicant is utilizing the transfer of development rights to <br />increase the allowed density from 40 to 61 units. <br />7.5. KCC 17.36.045 Review criteria
