The Contractor shatt take such action as may be required to <br />ensure futtcomptiance with the provisions in the immediatety preceding <br />paragraphs herein. <br />31. PrevaitingWage: <br />The Contractor shatl, pay the prevail,ing rate of wages to att workers, [aborers, or mechanics <br />empLoyed in the performance of any part of the Work in accordance with RCW 39.1 2 and <br />the rutes and regutations of the Department of Labor and lndustries. The schedute of <br />prevail,ing wages rates for the Locatity or tocal,ities of the Work is determined by the <br />lndustriat Statistician of the Department of Labor and lndustries. lt is the Contractor's <br />responsibil.ity to verify the appticabte prevail.ing wage rate. lt is understood that the <br />Contractor is responsibl,e for obtaining and compl,eting al.l. required government forms and <br />submitting same to the proper authorities. <br />Disputes regarding prevaiLingwage rates shal,l. be referred for arbitration to the Director of <br />the Department of Labor and lndustries. The arbitration decision shal,L be finatand <br />conctusive and binding on al,t parties invotved in the dispute as provided for by RCW <br />39.12.060. <br />32. Debarment Certification : <br />The Contractor certifies that it: <br />32.1 ls not presentl,y debarred, suspended, proposed for debarment, dectared <br />inel.igibte or votuntarity excl,uded f rom covered transactions by any Federat <br />department or agencY. <br />92.2 Has not within a three-year period preceding the execution of this contract <br />with Kittitas County, been convicted of or had a civiI judgment rendered <br />against them for commission of f raud or a criminaI offense in connection <br />with obtaining, attempting to obtain, or performing a publ'ic or private <br />agreement or transaction, viotation of FederaI or State antitrust statutes or <br />commission of embezztement, theft, forgery, bribery, fatsification or <br />destruction of records, making fal,se statements, tax evasion, receiving <br />sto[en property, making fal,se ctaims, or obstruction of justice. <br />Kittitas County ProfessionaI Services Agreement <br />Page13ofl9
