KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />AGENDA STAFF REPORT <br />AGENDA DATE: February 18, 2025 <br />ACTION REQUESTED: Request to Approve & Sign an Amendment to Lease <br />with Emory LLC for Airport Property within the <br />Industrial Area at Bowers Field <br />BACKGROUND: On September 1, 2008, Gilbert Emory, Manager for <br />Emory LLC, entered into a lease for County land <br />located at Bowers Field Airport within the Industrial <br />Area. This Lease is for Lot C-3 of the Bowers Field <br />Airport Binding Site Plan 2°a Amendment. An <br />adjustment of rental rate was previously approved <br />through a lease addendum in September 2018. <br />INTERACTION: <br />Per RCW 36.34.180 and the approved lease, the <br />County is required to renegotiate these long-term <br />leases every five years. As of August of 2023, the <br />five-year renegotiation was due. It is unclear the <br />reason this lease was not renegotiated at that time. <br />The lease "Rental Rate Adjustment" referenced a <br />Consumer Price Index (CPI) for re -adjustment (Size <br />Class D under 50,000) which has been discontinued <br />by the U.S. Bureau of Labor Statistics. For continuity <br />with current lease adjustment procedures for the <br />Industrial area, an increase of ten percent (10%) every <br />five years through the Lease term is proposed. All <br />other terms of said lease are effect and are not altered <br />by this Amendment. <br />Public Works; Emory LLC <br />RECOMMENDATION: Approve & Sign an Amendment to Lease with Emory <br />LLC for Airport Property within the Industrial Area at <br />Bowers Field for Lot C-3. <br />HANDLING: Return one original to Public Works <br />ATTACHMENTS: Lease Addendum; Original Lease <br />LEAD STAFF: Josh Fredrickson, Public Works Director <br />
