I <br />KIfiITAS COUNTY AIRPORT <br />participate in the performance of Agreements as defined in 49 CFR Section 23.5. <br />bonsequently, this Agreement is subject to 49 CFR Parl23 as applicable. <br />Lessee hereby assures that no person shall be excluded from participation in, <br />denied the behefits of or otherwise discriminated against in connection with the <br />award and performance of any contract, including leases and agreements, <br />covered by 49 CFR Part 23 on the grounds of race, color, nailonal origin or sex. <br />Lessee hereby assures that it will include the above clauses in all sub-leases and <br />cause sub-tenants to similarly include clauses in further sub-leases or partial <br />assignments. <br />BINDIN9 EFFECT AND BENEFIT: <br />This Lease shall be binding upon and inure to the benefit of the parties hereto, <br />their successors, assigns, partial assigns and subtenants. <br />12. ESTOPPELCERTIFICATES: <br />Lessor shall issue estoppel certificates to tenants, partial assignees, assignees, <br />and lenders of Lessee upon request and in forms required by such tenants, <br />partial assignees, assignees, and lenders. Lessee shall reimburse Lessor for its <br />actual, reasonable out of pocket costs in providing same. <br />11. <br />13 <br />14. <br />15. <br />16. <br />FIRE PROTECTION ASSESSMENT ln addition to any rentalherein provided, <br />the Lessee shail pay a fee which shall be in lieu of taxes for firc orotection <br />seryrbes. The annual rate shall be based upon the annualfire assessment <br />O-rm-ned by the Kittitas County Assessor and Kittitas County Fire & Rescue to <br />be calculated on January l"t of the current year. The assessment shall be pro- <br />rated monthly, due and payable concurrently with the monthly lease payment. <br />UTILITIES: The Lessee shall pay for extension of and all utility servies supplied to <br />tnfr-m-nes. Any such extensions shall be subject to the advance review of the <br />Lessor. <br />PURPOSE: lt is understood by Lessee that this lease rate is for a ground lease for <br />a private f- Hangar. The Lessee shall utilize the premises primarily for an a|craft <br />hangar for aircraft storage and maintenance at least seven (7) months out of each <br />cale-ndar year. No planes shall be allowed to be tieddown on the apron area of the <br />leased premises. <br />RULES AND REGUIATIONS: The Lessee agrees to comply with all pertinent <br />@softhefederal,stateandloca|governments,aswellasthe <br />rules, regulations, ordinances, and minimum standards of the Kittitas CountyAirport <br />(eowers Field), as are presently in effect and may in the future be adopted.
