20.3.2 Major Modification Review Process. Subsequent to the applicant's submission of an <br />application, and the Kittitas County Community Development Services Director's determination <br />that the application constitutes a Major Modification, the application shall necessitate an <br />amendment to the Development Agreement consistent with KCC 15A.11 and the process set <br />forth below: <br />Step One: Within 14 days of receipt of the application, the Kittitas County <br />Community Development Services Director shall notify the applicant in writing that the <br />application constitutes a Major Modification, and, if additional information is needed for <br />continued processing, the Kittitas County Community Development Services Director <br />notifies the applicant of the additional information needed. Notwithstanding the <br />foregoing, any additional information that the County requires of the applicant shall be <br />reasonably necessary for continued processing and shall not be duplicative of information <br />already on file. <br />Step Two: Upon receipt of all information necessary for continued processing, the <br />Kittitas County Community Development Services Director shall evaluate compliance of <br />the application with the State Environmental Policy Act and, if beyond the scope of the <br />RANCH ON SWAUK CREEK MDNS, the Kittitas County Community Development <br />Services Director shall issue a threshold determination. No threshold determination shall <br />be required if the Kittitas County Community Development Services Director determines <br />that the additional impacts associated with the Major Modification have been fully <br />disclosed and can be mitigated through compliance with the Development Standards or <br />additional conditions imposed by the County. <br />Step Three: Within 60 days after receipt of the application for the Implementing <br />Approval, rendering of a threshold determination, and submission by the application of <br />any requisite environmental documentation, the Kittitas County Community <br />Development Services Director shall make a recommendation to the Kittitas County <br />Board of County Commissioners on the Major Modification. Notice of the Kittitas <br />County Community Development Services Director's recommendation shall be published <br />in a newspaper of local circulation, together with the date of a public hearing before the <br />Kittitas County Board of County Commissioners on the Kittitas County Community <br />Development Services Director recommendation. The notice shall be published per <br />Kittitas County Code prior to the date set for a public hearing and written comments on <br />the proposed action shall be invited and accepted up until the close of the public hearing. <br />Upon close of the public hearing, the Kittitas County Board of County Commissioner's <br />shall render a decision on the Major Modification. The Kittitas County Board of County <br />Commissioner's decision shall be a final decision. Notice of the decision shall be <br />provided in writing to the applicant and published in a newspaper of local circulation. <br />The Kittitas County Board of County Commissioner's decision on the Major <br />Modification shall be a final land use decision appealable to Superior Court pursuant to <br />RCW 36.70C. <br />Development Agreement — Page 10 of 13 <br />
