4.3 Equipment. Equipment means tangible personal property having a useful life of more than one year <br />and a per -unit acquisition cost which equals or exceeds the lesser of the capitalization level <br />established by the non -Federal entity for financial statement purposes, or $5,000.00. <br />4.4 Exhibit: A document provided by the MLE Program that is also a part of this agreement and <br />incorporated by reference. <br />4.5 RBS Officer: Recreational Boating Safety Officer. A fully commissioned law enforcement officer in <br />Washington State who has the authority to enforce the laws of the State of Washington and local <br />ordinances. The RBS Officer must have attended the Washington State Basic Marine Law <br />Enforcement Academy, or an equivalent recognized by MLE. <br />4.6 Boating Safety Inspection: A full inspection of all safety equipment, vessel registration when <br />required, and mandatory boater education compliance when required. The results of the inspection <br />shall be documented through Washington's Statewide Electronic Collision and Ticket Online Records <br />(SECTOR). This may be done at the time of the inspection or when SECTOR is available to the RBS <br />Officer. <br />4.7 Law Enforcement Vessel: A vessel used by a law enforcement agency, which shall be equipped <br />with proper markings showing it to be an official law enforcement vessel. <br />4.8 Recreational Vessel: Defined in federal regulation 50 CFR 85.11 as a vessel owned and operated <br />primarily for pleasure, or a vessel leased, rented, or chartered to another for recreational use. <br />4.9 Subrecipient: A non-federal entity that receives a subaward from a pass -through entity to carry out <br />part of a federal program but does not include an individual that is a beneficiary of such program. In <br />this agreement, the subrecipient is the successful applicant with whom WA MLE is awarding a Federal <br />Financial Assistance Grant (See 2 CFR 200.93). <br />4.10 Subrecipient Grant Award: Also known as a subaward. Defined in federal regulation as "an award <br />provided by a pass -through entity to a subrecipient, in order for the subrecipient to carry out part of a <br />federal award received by the pass -through entity." It does not include payments to a contractor or <br />payments to an individual that is a beneficiary of a federal program. A subaward may be provided <br />through any form of legal agreement, including an agreement that the pass -through entity considers a <br />contract (See 2 CFR 200.92). <br />4.11 Boating Safety Program approval: means that the county or local jurisdiction has entered into an <br />agreement with State Parks to develop and maintain a boating safety program meeting the minimum <br />requirements established by State Parks. <br />SECTION 5: Agreement Term, Effective Date, and Duration <br />This agreement is effective on the date of the last signature. It will terminate on December 31, 2025, or the <br />date of final payment issuance, whichever is later, unless terminated earlier in accordance with Section 19 — <br />Termination, or extended via formal amendment as described in Section 20 - Amendments.
