If the meeting cannot resolve the issues and a local <br />government proceeds with a third request for additional information or corrections, the <br />local government must approve or deny the application upon receiving the additional <br />information or corrections. <br />Regardless of the option a jurisdiction chooses, every jurisdiction must provide annual reports, <br />beginning in 2026, that demonstrate if the required permit allowances are being met at least <br />50% of the time. If they are not being met the bill requires adoption of the measures noted <br />above (a-j) until permitting times are consistent with the statute. <br />Recommendation: <br />Utilizing option 1 appears to be the path of least resistance as follows: <br />• The County could choose to only collect 80% of the permitting fees upon application <br />submittal. <br />• Then require the remaining 20% upon successful permit issuance when timelines are <br />met. <br />Option 1 could avoid complicating financial records with various refunds when timelines are not <br />met. This may be especially true when application submittal and issuance timelines fall within <br />different budget cycles. <br />Maior Component to Comply: <br />• Possible adjustments to applications fees for this additional work requirement <br />• SmartGov assistance/cost: Additional training to run the appropriate stop and start <br />scenarios, and more importantly annual reports. <br />• This bill will require close monitoring and memorializing of all start and stop events in <br />application processing. <br />• The "shot clock" can be stopped anytime the applicant is informed of a need for <br />additional information. Maintaining clear records of these events will be vital for <br />reporting. <br />• The code will need to be updated to relay these new timelines and there are various <br />other more minor requirements that will need to be added as well. <br />o These include items like specific timelines and criteria for requesting information <br />and memorializing responses as well as some items that are exempt. <br />
