a Any lien asserted upon any property of the County in conneetion with the Services for thm <br />Agreement. <br />Any failure of Agency, or of the $erviees, to comply with any applicable law, ordinance, rule, <br />regulation, order, license, permit and other requirement, now or hereafler in effect, of any <br />governmental authority; or <br />Any breach of or default under this Agreement by Agency <br />t <br />€ <br />$ection 4, Compliance with Flrbliq Reeqr4s f-aw. <br />a. ln compliance with Washington's public records law, the Couniy will retain copies of any docunrents <br />associated with this ,Agreement, which may be required by law unless legally exenrpt front such <br />retention, for any applicable legally required retention period, <br />b. ln the event a public records request is made to the eounty for documents created in relation to thrs <br />Agreenrent, should legal uncertainty arise regarding the disclnsability of any dncuments undnr <br />federal or state public reeords laws, the Oounty shall prnvide notice ta Agency pursuan{ ic: <br />Washington's public reccrds act, chapter 42.56 ROW, to allow Agency to s*ek a court injunctir.:rr. <br />c, The County specifically shall not be liable to Agency for the CoLrnty's release under public recorrls <br />laws of any documents not protected by trademark, copyright or other law. <br />$qction $. lndustrial lnsura.nee Waiver. <br />With respect to per{ormance of this Agreement and as to any claims against the Oounty, its Adciitional <br />lnsureds, officers, agents and enrployees, the Agency expressly waives its imnrr,rnity under Title 51 of the <br />Revised Code of Washington, the lndustrial lnsurance Act, for injuries to Agency's enrployees and agrees <br />that the obligations to indemnify, defend and hold harmless provided in ihis Agreement extend to any elaint <br />brought by or on behalf of any employee of the Agency. This waiver is mutually negatiatael by the parties <br />to this Agreement, <br />Section 6. lnsurance and Endorsernents. <br />a.
