792 - Road Union <br />the prescribed treatment program, the employee will be reinstated to the <br />employee's previous position. Cost of the treatment program and any follow-up <br />services will be the sole responsibility of the employee or medical insurance <br />provider (within plan limitations). The Employer will be provided periodic <br />progress reports from the SAP during the treatment program. <br />The employee will be reinstated to the employee's former position when the <br />following conditions have been met: <br />The employee has successfully completed the treatment program; and <br />the SAP has formally released the employee to return to work; and <br />The employee agrees to submit to periodic substance abuse testing. <br />ln addition to any testing done as part of the treatment program, during <br />the next twelve (12) months following reinstatement, the employee <br />consents to be tested at random up to four (4) times for the presence of <br />alcohol, drugs, and/or controlled substances at any time, on a random <br />basis not withstanding any other provisions of this Agreement to the <br />contrary. <br />Any subsequent violation of this Agreement will be grounds for immediate <br />discharge. <br />2. Discharge the employee <br />22.5 Self-Recognized Substance Abuse: Employees who recognize that they have a substance abuse <br />problem must immediately notify the Human Resources Department of their condition. The HR <br />Department will make a referral to the EAP for substance abuse evaluation and treatment. lf, in <br />the opinion of the EAP's Substance Abuse Professional the employee requires treatment <br />services, the employee will be required to enroll in the recommended treatment program. Any <br />employee who complies with the above requirements prior to a violation of this policy shall be <br />immediately placed on unpaid leave in accordance with Article 22.4(L)lll above. <br />ARTICLE 23 - EMPLOYER CONDUCTED SEARCHES <br />23.L The Employer reserves the right to conduct searches of County property, vehicles, or <br />equipment, including electronic devices, at any time or place. Failure to cooperate with these <br />procedures, without just cause, will be grounds for discharge. <br />ARTICLE 24 - GRIEVANCE PROCEDURE <br />The parties hereto recognize the need for fairness and justice in the adjudication of employee, <br />Union and/or Employer grievances and enter into this Agreement in a cooperative spirit to <br />adjust such actions promptly and fairly at the lowest level possible. lf, however, a grievance <br />cannot be resolved through normal means, the grievance will be settled as hereinafter provided <br />a <br />b <br />c <br />d <br />24.1 <br />25
