Office of Columbia River
December 7,2024
Figure 1: Existing Place of Use (red outline in Section 30) and Proposed Place of Use (yellow)
Procedural Framework for Request
Our first request involves an assignment of the application from Joyce Palelek to Kittitas County
and we are in the process of preparing that on Ecology's required form. Based on our review of the
form, the statutory reference to RCW 90.03.310(below), and Ecology's policy guidance in PRO
1000(also below), this appears to be largely an exercise in ensuring that Ecology's contact
information on the application remains current. Absent additional technical assistance,we will
simply submit the form as required.
RCW 90.03.310
Appropriation procedure—Assignability of permit or application.
Any permit to appropriate water may be assigned subject to the conditions of the permit, but
no such assignment shall be binding or valid unless filed for record with the department.
Any application for permits to appropriate water prior to permit issuing, may be assigned by
the applicant, but no such assignment shall be valid or binding unless the written consent of
the department is first obtained thereto, and unless such assignment is filed for record with
the department.
Page 2
