BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION <br />NO. <br />RATIFYING THE CHAIR OF COUNTY COMISSIONER'S SIGNATURE ON THE TRUST <br />WATER RIGHTS PURCHASE AND SALE AGREEMENT WITH JAMES P. ROAN AND JAN <br />ROAN AND AUTHORIZING CHAIR SIGNATURE ON CLOSING DOCUMENTS <br />WHEREAS: Kittitas County maintains a water banking program accepted by the Washington State <br />Department of Ecology and administered by the Public Works Department; and <br />WHEREAS: James P. Roan and Jan Roan are the beneficial owner of surface water rights from First <br />Creek, assigned Certificate Nos. S4-85121-J and S4-85198-J ("Water Rights"); and <br />WHEREAS: James P. Roan and Jan Roan own Water Right Permits Nos. G4-35541, G4-35542, G4- <br />35543, G4-35544, G4-35545, G4-35546, G4-35547 and G4-35548 ("Water Right <br />Permits"); and <br />WHEREAS: On December 3r1, 2024, the Kittitas County Board of Commissioners entered into a <br />purchase and sale agreement for the consumptive and nonconsumptive portions of the <br />Remaining Water Rights and the remaining portion of the Water Right Permits; and <br />WHEREAS: The Purchase and Sale Agreement identifies several contingencies that need to be <br />satisfied to close the transaction; and <br />WHEREAS: One identified contingency is for the Kittitas County Board of Commissioners to pass a <br />Resolution in the ordinary course of its business ratifying the Purchase and Sale <br />Agreement. <br />NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the best interest <br />of the public, does ratify Chair of County Commissioner's Signature on the Trust Water Rights Purchase <br />and Sale Agreement with James P.
